AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE
SALES CONTRACT FOR THE ACQUISITION OF A 0.968 -ACRE
TRACT IN THE 9100 BLOCK OF SOUTH PADRE ISLAND DRIVE IN
FLOUR BLUFF, KNOWN AS LOT 1, LEXINGTON INDUSTRIAL CENTER,
FROM THE OWNER, RALPH E. KRAUSE, AND FOR THE PAYMENT TO
OWNER OF PAST RENTALS FOR AN EASEMENT FOR THE CITY'S HIGH.
PRESSURE GAS PIPELINE; APPROPRIATING OUT OF THE NO. 106
GAS FUND THE SUM OF $81,275, OF WHICH SUM $69,000 IS FOR
THE PURCHASE, $11,700 IS FOR THE EASEMENT RENTAL, AND
$575 IS FOR INCIDENTAL EXPENSES RELATED TO CLOSING COST;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized -
to execute a real estate sales contract with the owner, Ralph E. Krause,
for the acquisition of a 0.968 -acre tract in the 9100 block of South Padre
Island Drive in Flour Bluff, known as Lot 1, Lexington Industrial Center,
and for the payment to owner of past rentals for an easement for the City's
high pressure gas pipeline. Said rentals shall be Six Hundred Dollars ($600)
per month for the period from October 10, 1978 to October 9, 1979, and
Five Hundred Dollars ($500) per month from October 10, 1979 until closing.
SECTION 2. There is hereby appropriated out of the No. 106 Gas
Fund Eighty -One Thousand Two Hundred Seventy -Five Dollars ($81,275) of which
sum Sixty -Nine Thousand Dollars ($69,000) is for purchase of the property,
Eleven Thousand Seven Hundred Dollars ($11,700) is for easement rental,
and Five Hundred Seventy -Five Dollars ($575) is for incidental expenses
related to closing cost.
SECTION 3. The necessity to authorize the execution of the neces-
sary documents and to authorize the payment of funds for the acquisition of
the aforesaid real property in order to settle a pending lawsuit, assure
the present location of the City's gas pipeline and assure uninterrupted
service to gas customers in Flour Bluff and the Naval Air Station creates
a public emergency and an imperative public necessity requiring the suspen-
sion of the Charter rule that no ordinance or resolution shall be passed

finally on the date of its introduction but that such ordinance or resolu-
tion shall be read at three several meetings of the City Council, and the
Mayor, having declared that such emergency and necessity exist, having
requested the suspension of the Charter rule and that this ordinance be
passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this the 2/ day of May, 1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
