HomeMy WebLinkAbout15566 ORD - 05/28/1980jkh:5-28-80;1st AN ORDINANCE CLOSING A PORTION OF THE FOLLOWING STREETS: (1) A .0533 -ACRE PORTION OF HURON STREET ABUTTING LOT 1, BLOCK 15, MEADOWPARK ADDITION, AS RECORDED IN VOLUME 4, PAGE 52 OF NUECES COUNTY MAP RECORDS, SUBJECT TO RETENTION OF SAID PORTION AS A UTILITY EASEMENT; (2) A .0208 -ACRE PORTION OF RUTH STREET ABUTTING LOT 21, BLOCK 1, MEADOWPARK ADDITION, SUBJECT TO RETENTION OF SAID PORTION AS A UTILITY EASEMENT; A .0162 -ACRE PORTION OF RUTH STREET ABUTTING LOT 33, BLOCK 6, SEIKEL ADDITION AS RECORDED IN VOLUME 7, PAGE 32, NUECES COUNTY MAP RECORDS, SUBJECT TO RETENTION OF SAID PORTION AS A UTILITY EASEMENT; (4) THE 40 -FOOT RIGHT-OF-WAY OF MARY STREET BETWEEN LOT 1, BLOCK 3 AND LOT 1, BLOCK 6, SEIKEL ADDITION, AS RECORDED IN VOLUME 7, PAGE 32, NUECES COUNTY MAP RECORDS, SUBJECT TO THE RETENTION OF THE SOUTH 20 FEET OF SAID STREET FOR A UTILITY AND DRAINAGE EASEMENT, ALL AS MORE FULLY DESCRIBED AND ILLUSTRATED ON THE EXHIBITS ATTACHED HERETO AND MADE A PART HEREOF; AND DECLARING AN EMERGENCY. (3) WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of a portion of the hereinafter described streets, situated in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known address of the owners of property abutting said streets and within 450 feet of the area to be closed and there- after, pursuant to said notice, public hearing was held at Special Council Meeting of the City Council of the City of Corpus Christi on Wednesday, May 21, 1980, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the hereinafter described portion of the named streets for use as public streets, subject to the retention by the City of certain streets as utility easements: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter described portion of streets in the City of Corpus Christi, Nueces County, Texas, be and the same are hereby closed for use as public streets and hereby revert to the abutting property owners, subject to the retention by the City of certain streets or portions thereof as utility easements: 15566 • MICROFILMED AUG 2 91980 • • (1) A .0533 -acre portion of Huron Street abutting Lot 1, Block 15, Meadowpark Addition, as recorded in Volume 4, page 52, Nueces County Map Records, subject to reten- tion of said portion as a utility easement; (2) A .0208 -acre portion of Ruth Street abutting Lot 21, Block 1, Meadowpark Addition, subject to retention of said portion as a utility easement; (3) A .0162 -acre portion of Ruth Street abutting Lot 33, Block 6, Seikel Addition as recorded in Volume 7, page 32, Nueces County Map Records, subject to reten- tion of said portion as a utility easement; (4) The 40 -foot right-of-way of Mary Street between Lot 1, Block 3 and Lot 1, Block 6, Seckel Addition, as recorded in Volume 7, page 32, Nueces County Map Records, sub- ject to retention of the south 20 feet of said street as a utility and drainage easement, all as more fully described and illustrated on the exhibits attached hereto and made a part hereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of the City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the portions of the aforementioned streets creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule, that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ,z4 day of May, 1980.
