AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXTEND THE CONTRACT WITH
COMMUNITY ACTION CORPORATION OF SOUTH TEXAS FOR PREPARA-
TION AND DELIVERY OF FIFTY (50) MEALS FOR THE CITY'S
ELDERLY NUTRITION PROGRAM IN BISHOP, TEXAS AND BANQUETE,
TEXAS FOR A PERIOD NOT TO EXCEED SEPTEMBER 30, 1980, AT
WHICH TIME A NEW CONTRACT WILL BE NEGOTIATED, ALL AS
MORE FULLY SET FORTH IN THE CONTRACT IN SUBSTANTIALLY
THE SAME FORM ATTACHED HERETO MARKED EXHIBIT "A" AND
MADE A PART HEREOF FOR ALL PERTINENT PURPOSES; AND
AUTHORIZING THE EXECUTION OF ALL DOCUMENTS AS MAY BE
NECESSARY IN THE CONTINUATION OF THIS PROGRAM; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1.That the City Manager be and he is hereby authorized to
extend the contract for preparation and delivery of fifty (50) meals for
the Elderly Nutrition Program in Bishop and Banquete for a period not to
exceed four (4) months ending September 30, 1980 after which a new contract
will be negotiated and will commence October 1, 1980, all as more fully set
forth in an amendment to the contract, a substantial copy of which is attached
hereto and made part hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize execution of the aforesaid
contract and all related documents in order to continue the administration of
an elderly nutrition program creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at -three several meetings of the
City Council, and the Mayor having declared such emergency and necessity to
exist, having requested the suspension of the Charter rule and that this
ordinance take effect and be in full force and effect from and afte1 t

AMENDMENT NUMBER 1
TO CONTRACT BETWEEN
COMMUNITY ACTION CORPORATION OF SOUTH TEXAS
AND
SENIOR COMMUNITY SERVICES, CITY OF CORPUS CHRISTI
Section I. Parties to Amend
The Community Action Corporation of South Texas, a private non—profit
corporation, hereinafter referred to as the "Contractor" and the City of
Corpus. Christi, hereinafter referred to as the "City", do hereby agree and
contract to amend their original contract and agreement as initially executed
by the Executive Director of the Contractor and the City Manager of the City,
effective January 15, 1980.
Section II. Amended Contract Period
The parties hereby agree to amend Section II of the contract, to read
as follows:
Section II. Contract Period
All services to be performed by the contractor shall commence January 15,
1980 and shall terminate Septembar.30, 1980, such period referred to herein.
as "Contract Period".
Section III. City Performance
After the first month of operation, the Contractor shall submit, at
intervals specified below, reimbursement vouchers for:the purchase of goods
and services. In consideration of the Contractor's full and satisfactory
performance, the City will provide remuneration calculated per unit of services
and day of delivery.

Remuneration shall be calculated as the sum of $1.50 per meal prepared from
January 15, 1980 to September 30, 1980, and $15.50 per service day for delivery
from January 15, 1980 to June 15, 1980, and $18.00 per service day for
delivery from June 16, 1980 to September 30,'1980. To initiate payment, the
Contractor will submit to the City, no later than ten working days subsequent
to the close of each month, a reimbursement voucher for the purchase of goods
and services. The City shall render payment to the Contractor no later than -
fifteen days subsequent to the receipt of reimbursement voucher.
Section IV. Amendment Agreement
The parties hereto agree that this amendment shall become effective on the
16th day of June, 1980.
The parties hereto contract and agree that all the terms of the above
named contract shall remain in effect and shall continue to govern except to
the extent that they conflict with this agreement. -
By the signing of this agreement, the parties expressly understand and
agree that this amendment is hereby made a part of the contract identified
above in Section I as though it were set forth word for word therein.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter,
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
