AN ORDINANCE
AMENDING ORDINANCE NO. 14698, PASSED AND APPROVED
BY THE CITY COUNCIL ON JANUARY 3, 1979, WHICH
GRANTED A SPECIAL COUNCIL PERMIT TO RANDAL STIVERS,
JIM NIX AND JOE ADAME ON THE LAND AREA CONSISTING
OF 14.315+ ACRES AND CHANGED THE ZONING OF THE
WATER AREA -CONSISTING OF 12.303+ ACRES, THE SAID
AREA BEING ALL OF THE MOST SOUTHERLY 216.10+ FEET
OF LOT 2, LOTS 3 AND 4, C. G. GLASSCOCK BAY FRONT
BAY ADDITION AND BOAT HARBOR, LOCATED ON THE EAST
SIDE OF OCEAN DRIVE NORTH OF COLE PARK, SITUATED IN
THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS,
BY CORRECTING THE PROVISIONS SO AS TO PERMIT THE
INTENDED USES AS THEY PERTAIN TO ARTICLE 24 OF THE
ZONING ORDINANCE FOR "B-5" PRIMARY BUSINESS DISTRICT
ZONING, AS MORE FULLY SET FORTH HEREINAFTER; KEEPING
IN EFFECT ALL OTHER PROVISIONS OF THE SAID ORDINANCE
NO. 14698; AND DECLARING AN EMERGENCY.
WHEREAS, by Ordinance No. 14698, the City Council granted a Special
Council Permit to Randal Stivers, Jim Nix and Joe Adame on the land area con-
sisting of 14.315± acres and by changing the zoning of the water area consist-
ing of 12.303+ acres, the said are being all of the most southerly 216.10+
feet of Lot 2, Lots 3 and 4, C. G. Glasscock Bay Front Bay Addition and Boat
Harbor, located on the east side of Ocean Drive north of Cole Park, situated
in the City of Corpus Christi, Nueces County, Texas; and
WHEREAS, error was made in the granting of certain uses with regard
to Article 24 of the Zoning Ordinance for "B-2" Bayfront Business District
zoning; and
WHEREAS, it is the desire of the City Council to correct such
error by amending the ordinance granting the said Special Permit to permit the
intended uses as they pertain to Article 24 of the Zoning Ordinance for "B-5"
Primary Business District zoning:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance No. 14698, passed by the City Council on
January 3, 1979, be amended by amending Section 2, the first paragraph, by
deleting the following words from the last sentence, "shall be subject to the
conditions set forth as follows:", and in lieu thereof adding the following:
"shall permit 'B-5' Primary Business District regulations as they pertain to
Article 24 Height, Area and Bulk Reguirements and in all other regards to
regulations of 'b -z• Bayfront business District snali apply subject to the
conditions set forth as follows:".

SECTION 2. Except as herein and hereby amended, the terms, conditions
and provisions of Ordinance No. 14698 shall be and remain in full force and
effect.
SECTION 3. The necessity to correct the ordinance granting Special
Council Permit and zoning change on the hereinabove described property at the
earliest practicable date creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or re-
solution shall be passed finally on the date of its introduction but that such
ordinance or resolution shall be read at three several meetings of the City
Council, and the Mayor, having declared that such emergency and necessity
exist, having requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the /1 day of June, 1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
