HomeMy WebLinkAbout15592 ORD - 06/11/1980AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLU- TION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY AMENDING SECTION 31-5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED 31- 5,24, SETTING FORTH ZONING CLASSIFICATION ON THE DESCRIBED TRACT OF LAND, WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING DESCRIBED AS LOT 5, RIVER VIEW ESTATES, IN NUECES COUNTY, TEXAS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendment to the text of the Zoning Ordinance of the City of Corpus Christi; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the'public, said public hearing having been held on June 11, 1980, at Regular Council Meeting of the City Council in the City Council Chambers of the City Hall in the City of Corpus Christi; and the City Council further finds as follows: (1) That the Planning Commission of the City of Corpus Christi has found the proposed change in zoning is in the public interest and within the purpose of the zoning ordinance; and, that permanent zoning of "T -1B" Mobile Home Park should be granted to the tract of land consisting of approxi- mately 25 acres of land, being described as Lot 5, River View Estates; (2) That the agreement for the contractual annexation of the land described herein to the City of Corpus Christi does not contain any condition of rezoning said land by the City Council, and that such contract contains no reference to zoning. (3) That the permanent zoning of "T -1B" Mobile Home Park be granted to the 25 acre tract of land, more or less, hereinafter described; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would MICROFILMED AUG 2 91980 1559 • serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the change hereinafter set out. SECTION 2. There is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31-5.24, said new subsection to hereafter read as follows, such zoning classification of the hereinafter described property to be effective upon annexation: "Section 31-5.24 The following described tract of land shall be zoned and classified 'T -1B' Mobile Home Park: Lot Five (5), River View Estates, as shown by map or plat thereof recorded in Volume 34, at page 115, of the Map Records, Nueces County, Texas." SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its -2- • introduction and take effect and be in full force and effect from an fter its passage, IT IS ACCORDINGLY SO ORDAINED, this the /J day of 1980.
