HomeMy WebLinkAbout15601 ORD - 06/18/1980AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A MEMORANDUM OF AGREEMENT WHEREIN THE WOMEN, INFANTS, AND CHILDREN (WIC) PROJECT #38 OF THE CORPUS CHRISTI - NUECES COUNTY DEPARTMENT OF PUBLIC HEALTH AND WELFARE WILL PAY TO LULAC VILLAGE $300.00 PER MONTH FOR USE OF 2,975 SQUARE FEET OF SPACE AT 1417 HORNE ROAD, ALL AS MORE FULLY SET FORTH IN THE MEMORANDUM OF AGREEMENT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AS EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a Memorandum of Agreement wherein the Women, Infants, and Children (WIC) Project #38 of the Corpus Christi - Nueces County Department of Public Health and Welfare will pay to Lulac Village $300.00 per month for use of approximately 2,975 square feet of space at 1417 Horne Road,all as more fully set forth in the Memorandum of Agreement, a substantial copy of which is attached hereto as Exhibit "A". SECTION 2. The necessity to authorize execution of the aforesaid Memorandum of Agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its int:-oduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the a day of June, 1980. Box 9727 Corpus Christi, Texas 78408 MEMORANDUM OF AGREEMENT It is hereby agreed that the WIC Project #38 of the Corpus Christi-Nueces County Department of Public Health and Welfare, will render payment of three hundred doltars($300.00) per month to Lulac Village for the use of approximately 2,975 square feet of space in its single story store building located at 1417 Horne Road, Corpus Christi, Texas. This space will be used each weekday morning, Monday through Friday, from 8:00 a.m. to 12:00 noon for WIC participants who are returning each month for their nutrition education and food vouchers. The payment rendered by the WIC Project #38 to Lulac Village includes coverage of costs of utilities and daily janitorial and grounds -keeping services. This agreement shall be effective on , 1980 and shall continue for one year from that date or until terminated by written notice given 45 days in advance by either party to the other. At the end or other expiration'of the term, Lessee shall deliver up the premises in good order and condition, natural wear and tear and damages by fire and the elements only excepted. No improvements or alterations shall be made in or to the hereby demised premises without the consent of the Lessor in writing; all improvements made by the Lessee to belong to the Lessor at the expiration of the hereby granted lease. The responsibility for all maintenance and repairs shall be that of the Lessor and shall be carried out promptly to ensure that the premises remain in good order at all times. Lessor shall have full right of use of the premises during such times as are not specified herein for use by the Lessee, but shall at all times be responsible for returning the premises to its usual condition for use by Lessee at its next use period. Full responsibility for the premises, its protection and maintenance, shall be that of the Lessor during all times not herein specified for use by Lessee, and the Lessor shall hold harmless the Lessee for any damage to or liability arising out of such premises • • Corpus Christi-Nueces County Dept of Public Health and Welfare Memorandum of Agreement Page 2 during such times as the premises are not in use by or under the physical control of Lessee. Adequate parking facilities for Lessee's employees and clientele is included as a part of this agreement and shall be provided by Lessor out of such parking facilities as are available at or near the leased premises.
