HomeMy WebLinkAbout15612 ORD - 06/25/1980• AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH NUECES DEVELOPMENT COMPANY, DEVELOPER OF COUNTRY ESTATES SUBDIVISION, UNIT 9, PROVIDING FOR THE CITY'S SHARE OF CONSTRUCTION COSTS OF AN OFF-SITE SANITARY SEWER EXTEN- SION TO THE SUBDIVISION, A SUBSTANTIAL COPY OF WHICH AGREE- MENT IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; APPROPRIATING $8,458.80 OUT OF THE NO. 250 SANITARY SEWER BOND FUND FOR PAYMENT TO NUECES DEVELOPMENT COMPANY UPON COMPLETION BY THE DEVELOPER AND ACCEPTANCE OF THE SUBDIVISION BY THE CITY APPLICABLE TO PROJECT NO. 250-77-30, COUNTRY ESTATES SUBDIVISION, UNIT 9; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute an agreement with Nueces Development Company, developer of Country Estates Subdivision, Unit 9, providing for the City's share of construction costs of an off-site sanitary sewer extension to the said subdivision, a substantial copy of which agreement is attached hereto and made a part hereof, marked Exhibit A. SECTION 2. That there is hereby appropriated the sum of $8,458.80 out of the No. 250 Sanitary Sewer Bond fund for payment to Nueces Development Company upon completion by the developer and acceptance of the subdivision by the City, applicable to Project No. 250-77-30, Country Estates Subdivision, Unit 9. SECTION 3. The necessity to authorize execution of the aforesaid agreement and appropriation of the sums set forth in order that the off-site sanitary sewer extension may be completed to the Country Estates Subdivision, Unit 9, creates a public emergency, requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction 15612 MICROFILMED PUG 291980 and take effect and be in full force and effectlfrom and after its passage, IT IS ACCORDINGLY SO ORDAINED, this thej$'ttay of June, 1980 ATTEST: Aj"-1--11.---dti- Ci y Secre qry APPROVED: day of June, 1980: J. NOW, THEREFORE, the City and the Developer agree as follows: 1. The Developer will contract for, and construct a 15" diameter sanitary sewer from Hearn Road, noted as Point A on the attached EXHIBIT A, westerly in an existing utility easement a distance of approximately 825 LF to a point labeled B on EXHIBIT A. City will pay material cost only of 15" diameter pipe delivered to the site. Such payment is determined to be $7.77 per LF of pipe per City's share. Excepting 8" diameter pipe stub -outs from manholes from Point A to Point B as described, and payment for pipe material cost for 15" diameter pipe, all costs from Point A to Point B will be borne by Developer. 2. Developer will also construct an 8" diameter sanitary sewer from Point B as described westerly to the east boundary of Country Estates No. 9 Subdivision and within said subdivision all at Developer's expense. City will'reimburse Developer for approximately 194 LF of 8" diameter sanitary sewer at Developer's in place cost, including stub -outs, at the intersection of Brookhill Drive and McBurnett. Drive. Line is to be plated at this location to facilitate future extension of said 8" diameter line by the City. See EXHIBIT "B" for details of this item. 3. The City agrees to reimburse the Developer as its share for the cost of the above stated construction, including 73Z engineering, the sum of Eight Thousand Four Hundred Fifty -Eight and 80/100 Dollars ($8,458.80). See attached Exhibit "C" for cost basis for this agreement. Such reimbursement will be made by.the City to the Developer upon completion and acceptance of the improvements by the City. 4. The Developer agrees to indemnify the City against any claims arising as a result of the project. 5. This agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors, and assigns. WITNESS this day of , 1980.
