HomeMy WebLinkAbout15645 ORD - 07/16/1980jkh:7-14-80;1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A PARTIAL RELEASE OF AN EASEMENT ACROSS LOT 1, BEHMANN ADDITION TO THE CITY OF CORPUS CHRISTI, TEXAS, BEING MORE FULLY DESCRIBED IN VOLUME 1183, PAGES 430-434, DEED RECORDS, NUECES COUNTY, TEXAS, A SUBSTANTIAL COPY OF SAID PARTIAL RELEASE BEING ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a partial release of an easement across Lot 1, Behmann Addition to the City of Corpus Christi, Texas, being more fully described in Volume 1183, pages 430-434, Deed Records, Nueces County, Texas, a substantial copy of said Partial Release being attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to authorize execution of the aforesaid partial release of an easement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY 50 ORDAINED, this the /(Q "'day of July, 1980. BRUCE AYCOCK, CITY ATTORNEY By Assistant Cit MAYOR THE 1_5645 Y OF CORPUS CHRISTI, TEXAS MICROFI' "rail AUF " ..,30, THE STATE OF TEXAS COUNTY OF NUECES PARTIAL RELEASE OF EASEMENT KNOW ALL MEN BY THESE PRESENTS • That the City of Corpus Christi on the 9th day of January, 1969 was assigned all. right, title and interest in and to certain pipeline easements over, under and across lands described in an amendedpipelineeasement instru- ment dated November 27, 1966, as recorded in Volume 1183. page 430-434, Deed Records, Nueces County, Texas; and That, in addition to said easement described above, Humble Pipeline Company, as assignor, did simultaneously assign and transfer certain other pipe- line easements to the City of Corpus Christi, none of which such easements are affected hereby. Now, therefore, for and in consideration of the sum of $10.00 to it in hand paid by the owner of the land described herein, the receipt of which is hereby acknowledged, the City of Corpus Christi releases, quitclaims and abandons such pipeline easement as to the following described land, to -wit: Lot One (1), Behmann Addition to the City of Corpus Christi, being a .516 acre tract of land out of Lot Nine (9), Section D, Paisley's Subdivision of the Hoffman tract, as shown by map or plat thereof as recorded in Volume 28, page 17, Map Records, Nueces County, Texas. It is hereby expressly provided that this instrument constitutes a partial release of easement and in no way releases or abandons the remainder of said ease- ments transferred by Humple Pipeline Company to the City of Corpus Christi by assignment dated January 9, 1969, recorded in Volume 1319, page 257, Deed Records, Nueces County, Texas.
