HomeMy WebLinkAbout15666 ORD - 07/30/1980AN ORDINANCE CLOSING AND ABANDONING THE 7.5 FOOT UTILITY EASEMENT OUT OF LOT 2, BLOCK 4, ST. CLAIR INDUSTRIAL PARK, RECORDED IN VOLUME 44, PAGE 68, MAP RECORDS, NUECES COUNTY, TEXAS, SUBJECT TO PAVING OF THE INTERIOR STREETS IN ST. CLAIR INDUSTRIAL PARK AND DEDICATION OF AN ALTERNATE EASEMENT, ALL AT THE OWNER'S EXPENSE; AND DECLARING AN EMERGENCY. • WHEREAS, there exists a 7.5 -foot utility easement in Lot 2, Block 2, Block 4, St. Clair Industrial Park, recorded in Volume 44, page 68, Map Records, Nueces County, Texas; and .- WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to paving of interior streets in St. Clair Industrial Park•and dedication of an alternate easement, all at the owner's expense: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described 7.5 -foot utility easement in Lot 2, Block 4, St. Clair Industrial Park,,recorded in Volume 44, page 68, Map Records, Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to dedication of an alternate easement and subject to paving of the interior streets in St. Clair Industrial Park, all at the owner's expense, said utility easement being described as follows: BEING a 0.075 acre, more or less, tract of land out of Lot 2, Block 4, St. Clair Industrial Park as shown by plat recorded in Volume 44, Page 68, Map Records, Nueces County, Texas, said 0.075 acre tract of land being more particularly described as follows: BEGINNING at the northwest corner of said Lot 2, Block 4, said point also being on the east right-of-way line of Heinsohn Road for the northwest corner and POINT OF BEGINNING of this tract; THENCE, EAST, with north boundary line of said Lot 2, Block 4, 436.90 feet to the northeast corner of this tract; THENCE, SOUTH, 7.50 feet to the southeast corner of this tract; THENCE, WEST, 436.90 feet to the east right-of-way line of Heinsohn Road and the west boundary line of Lot 2, Block 4, for the southwest corner of this tract; THENCE, NORTH with said right-of-way line and said west boundary line, 7.50 feet to the POINT OF BEGINNING, and containing 0.075 acres, more or less. 15666 jO LME[ rjj 2 EicK, SECTION 2. If for any reason'any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would he better served by the closing of the aforesaid easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the sus- pension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 5Q ay of 1980. Christi, Texas 3922.1 day of • , 19 SID TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally,on the date it is introduced, or at the present meeting of the City Council.
