HomeMy WebLinkAbout15670 ORD - 07/30/1980AN ORDINANCE r CLOSING AND ABANDONING THE HEREINAFTER DESCRIBED PORTION OF A UTILITY EASEMENT OUT OF LOT 1-R, CORMAR INDUSTRIAL TRACTS, AS RECORDED IN VOLUME 44, PAGE 35, MAP RECORDS, NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a utility easement in Lot 1-R, Cormar Industrial Tracts, as recorded in Volume 44, page 35, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described portion of a utility easement out of Lot 1-R, Cormar Industrial Tracts, as recorded in Volume 44, page 35, Map Records, Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, said portion of easement being described as follows: Being a 0.117 acre, more or less, tract of land out of Lot 1-R, Cormar Industrial Tracts, as shown by plat recorded in Volume 44, page 35, Map Records, Nueces County, Texas, said tract being more particularly described as follows: COMMENCING at the south corner of said Lot 1-R, THENCE, N 00 03' 40" E along the westerly boundary line of said Lot 1-R, a dis- tance of 530.18 feet to an interior corner of said Lot 1-R for an interior corner of this tract and the POINT OF BEGINNING of this tract; THENCE, N. 89° 58' 11" W along the southerly boundary line of said Lot 1-R, a dis- tance of 5.00 feet to a point for' an exterior of this tract; THENCE, N 0° 03' 40" E, 507.48 feet to a point on a northerly boundary line of said Lot 1-R for an exterior corner of this tract; THENCE, S 89° 58' 11" E along said northerly boundary line and'its easterly projection, at 5.00 feet pass an interior corner of said Lot 1-R, in all a dis- tance of 10.00 feet to a point for an exterior corner of this tract; THENCE, S 0° 03' 40" W, 507.48 feet to a point which is an easterly projection of the southern boundary line of said Lot 1-R for an exterior corner of this tract; THENCE, N 89° 58' 11" W along the easterly projection of the southern boundary line a distance of 5.00 feet to the POINT OF BEGINNING. • • SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid portion of utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolu- tion shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having req asted the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 30 ay of July, 1980.
