An ORDINANCE
CLOSING AND ABANDONING A PORTION OF PATTON STREET
RIGHT-OF-WAY ADJACENT TO TRACT C, LOT 4, LOKEY
SUBDIVISION, AS HEREINAFTER MORE FULLY DESCRIBED,
ACCORDING TO MAP OF WHICH IS RECORDED IN VOLUME
35, PAGE 85, MAP RECORDS OF NUECES COUNTY, TEXAS;
AND -DECLARING AN EMERGENCY.

WHEREAS, notice of the time and place for holding a hearing concerning
the closing of _a portion of Patton Street right-of-way adjacent to Tract C.
Lot 4, Lokey Subdivision, as hereinafter more fully described, according to
map of which is recorded in Volume 35, page 85, Map Records of Nueces County,
Texas, being situated in the City of Corpus Christi, Nueces County, Texas,
was given by publication and mailed to the last known addresses of the owners
of property abutting the public way proposed to be closed, and thereafter,
pursuant to said notice, public hearing was held at Regular Council Meeting
by the City Council of the City of Corpus Christi on August 6, 1980, in
accordance with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after such hearing
that the said portion of Patton Street right-of-way, proposed to be closed,
is not needed now, nor will it be within the foreseeable future needed as
public right of way, and that the same should revert to the abutting property
owners:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the portion of Patton Street right-of-way adjacent
to Tract C, Lot 4, Lokey Subdivision, more fully described hereinafter, as
shown by map of record in Volume 35, page 85, Map Records of Nueces County,
Texas, be and the same is hereby closed for use as a public street and shall
revert to the abutting property owners:
Beginning at a 5/8 inch iron rod set on the existing
Northwest right-of-way line of Patton Street for the East
corner of this tract from which corner a 5/8 inch iron Erod.ICROFILMED
found for the 'East corner of said Tract -C bears North IVB

Thence win said existing Northwest right-of-way line
of Patton Street, along a circular curve to the right whose
radius point bears North 61°00'00" ?lest 10.00 feet and
having a central angle of 89°59'20', a radius of 10.00 feet,
a tangent distance of 10.00 feet, 15.71 feet to a 5/8 inch
iron rod set for a point of tangency of said Tract -C and
an angle point in said right-of-way for the North corner of
this tract/

Thence South 29°00'00" West, along the existing North -
wast right-of-way line. of Patton Street, 60.00 feet to a
5/8 inch iron rod set for an angle point in said right-of-
way and the point of curvature of a circular curve to the
right whose radius point bears South 28°59'20" West 10.00
feet and has a central angle of 90°00'40° a radius of 10.00
feet, a'tangent distance of 20.00 feet and an arc length of
15.71 feet;
Thence with said curve to the right, along said existing
right-of-way. 15.71 feet to a 5/8 inch iron rod set for the
point of tangency and the South corner of this tract,
Thence North 29°00'00" East, along the proposed new
right-of-way line of Patton Street, 80.00 feet tt the
Place of Beginning, containing 644.688 square feet of land.
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction
it shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
or provision hereof be given full force and effect for its purpose.
SECTION 3. The fact that the public convenience and necessity would
be better served by the closing of the aforesaid unnamed dedicated roadway
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be passed
finally on the date of its introduction but that such ordinance or resolution
shall be read at three several meetings of the City Council, and the Mayor, having
declared that such emergency and necessity exist, and having requested the sus—
pension of the Charter rule and that this ordinance be passed finally on the date
of its introduction and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED, this the(piay of August, 1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
