AN ORDINANCE
DECLARING A STATE OF EMERGENCY DURING THE NATURAL DISASTER
CREATED BY HURRICANE ALLEN IN THE CITY OF CORPUS CHRISTI,
TEXAS AND FOR THE ENSUING -7 DAYS; RATIFYING AND AFFIRM-
ING THE EMERGENCY REGULATIONS, ORDERS AND ACTIONS HERETOFORE
ENFORCED BY THE CITY MANAGER SINCE HURRICANE ALLEN STRUCK THE
CITY; ESTABLISHING CURFEW, SUBJECT TO DAILY EMERGENCY PASSES;
PROVIDING NOTICE; PROVIDING SEVERABILITY; AND DECLARING AN
EMERGENCY.
WHEREAS, on August 9, 1980, Hurricane Allen hit Corpus Christi;
and
WHEREAS, it is the finding of the Corpus Christi City Council
that as a result of Hurricane Allen, widespread and severe damage has been
done to property within the city, and that basic necessities are unavailable
to citizens or in inadequate supply, and a grave peril is presented to the
public health, safety and welfare:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City of Corpus Christi is under a state of
emergency and has been since the impact of Hurricane Allen on August 9, 1980.

SECTION 2. That`this declaration is authorized by Teas and
Federal Law and will remain in force for - days from date of adoption of
this Ordinance, subject to successive renewals.
SECTION 3. That the City Council hereby ratifies and affirms the
emergency regulations, orders and actions heretofore enforced and undertaken
by the City Manager, his officers, assistants, agents and deputies, pursuant
to the Mayor's statements and directives, and those contracting with the City
pursuant to such regulations, orders and actions, and hereby authorizes the
City Manager to provide, or cause to be provided, all arrangements, provisions
and means he deems necessary and proper to effect coordination of relief and
aid programs, and property restoration and rehabilitation programs, for the
protection, preservation, and improvement of life and property within the
City during said state of emergency.

SECTION 5. Public notic& of this ordinance shall be posted an 1 OP, eu.( o•f

distributed forthwith.
SECTION 6. -If for any reason any section, paragraph, phrase,
word or provision of this ordinance shall be held invalid or unconstitutional
by final judgment of a court of competent jurisdiction, it shall not affect
any other section, paragraph, subdivision, clause, phrase, word or provi-
sion of this ordinance, for it is the definite intent of this City Council
that every section, paragraph, subdivision, clause, phrase, word or provi-
sion hereof be given full force and effect for its purpose.
SECTION 7. -The necessity to immediately reduce to writing the
fact that a state of emergency exists in the City as a result of Hurricane
Allen and to ratify and affirm the emergency regulations, orders and actions
heretofore enforced by the City Manager creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor, having declared that
such emergency and necessity exist, having requested that such Charter
rule be suspended and that this ordinance be passed finally on the date of.
its introduction and take effect and be in full force and effect from and
after its passage, IT IS ACCORDINGLY SO ORDAINED, this the l6i14day of

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
