AN ORDINANCE
AMENDING SECTION 49-12, PETITION TO COUNCIL TO ESTABLISH
OR CLOSE STREETS, ETC., OF THE CORPUS CHRISTI CITY CODE,
1976 REVISION, SO AS TO PROVIDE FOR FILING REQUEST FOR
SAID ESTABLISHING OR CLOSING OF STREETS WITH THE DIRECTOR
OF ENGINEERING AND PHYSICAL DEVELOPMENT AND TO INCREASE THE
APPLICATION FEE FOR SUCH ESTABLISHING OR CLOSING OF STREETS
FROM $100 TO $200; REPEALING ALL ORDINANCES IN CONFLICT
HEREWITH; PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the Corpus Christi City Code, 1976 Revision, as
amended, be amended by amending Section 49-12, Petition to council to
establish or close streets, etc., to hereafter read as follows:
"Sec. 49-12. Petition to council to establish or close
Streets, etc.
All persons desiring to have the city council exercise its
powersunder section 6 of article IX of the charter, regarding the establish-
ment or closing of public streets, alleys, or other public ways, shall file
their request with the Director of Engineering and Physical Development, in
writing, directed to the city council. Such request shall contain an accu-
rate description of the street, or portion thereof, desired to be opened,
closed or altered, as the case may be, and attached to such request shall
be a list of all owners abutting the street or alley and within four hundred
fifty (450) feet therefrom, together with the last known address of all
such owners. Unless all such owners of abutting property join in the
petition, a statement shall be attached to the petition showing the reason
for nonparticipation of those who have not signed the petition.
Upon the filing of such request with the Director of Engineering
and Physical Development, as provided in this section, a deposit shall be
made with the Director of Engineering and Physical Development of the sum
of Two Hundred Dollars ($200) to cover the expenses of mailing such notices
and making such publications. In the event the charges shall exceed the
sum of Two Hundred Dollars ($200), the applicant shall pay the amount of
such fees in excess of such sum."
SECTION 2. That all ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed to the extent of conflict
herewith.

SECTION 3. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction it
shall not affect any other section, paragraph, subdivision, clause, phrase,
word or provision of this ordinance, for it is the definite intent of this
City Council that every section, paragraph, subdivision, clause, phrase, word
pr provision hereof be given full force and effect for its purpose.
That the foregoing ordinance was read for the first time and assed to its

MOTION
Council Member David Diaz moved and Council Member Betty Turner
seconded the motion that the ordinance authorizing an amendment to the Code of
Ordinances to amend Section 49-12, Petition to council to establish or close
streets, etc., to increase the filing fee for closing a street from $100 to
$200, read on the first and second readings on July 30, 1980 and August 6, 1980,
respectively is hereby amended prior to the third reading as follows:
"Section 49-12. Petition to council to establish or close streets,
etc.
