AN ORDINANCE
AMENDING THE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI,
1976 REVISION, AS AMENDED, BY ADDING A SECTION TO PROVIDE
FOR PAYMENT OF $100.00 FEE FOR PROCESSING OF REQUEST FOR
CLOSING OR ABANDONMENT OF AN EASEMENT, SAID SECTION TO BE
NUMBERED 49-13, AND ENTITLED "REQUEST FOR CLOSING OR
ABANDONMENT OF EASEMENT"; REPEALING ALL ORDINANCES IN CON-
FLICT HEREWITH; PROVIDING FOR SEVERANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:

SECTION 1. That the Code of Ordinances, City of Corpus Christi,
1977 Revision, as amended, be amended by adding a new section, to be numbered
Section 49-13, entitled "Request for closing or abandonment of easement,"
to hereafter read as follows:
"Sec. 49-13. Request for closing or abandonment of easement.
All persons desiring to have the city council close or abandon
an easement shall file their request with the Director of Engineering and
Physical Development, in writing, directed to the City Council. Such
request shall contain an accurate description of the easements, or portions
thereof, desired to be closed or abandoned.
"Upon filing of such request, as provided in this section, a
deposit shall be made with the Director of Engineering and Physical Develop-
ment of the sum of One Hundred Dollars ($100) to cover the expense of
processing the request."
SECTION 2. If for any reason any section, paragraph, subdivision,
clause, phrase, word or provision of this ordinance shall be held invalid
or unconstitutional by final judgment of a court of competent jurisdiction,
it shall not affect any other section, paragraph, subdivision, clause,
phrase, word or provision of this ordinance, for it is the definite intent
of this City Council that every section, paragraph, subdivision, clause,
phrase, word or provision hereof be given full force and effect for its
purpose.

MOTION
Council Member David Diaz
moved and Council Member Betty Turner
seconded the motion that the ordinance authorizing an amendment to the Code
of Ordinances by adding a section to provide for a payment of a $100.00 fee
for the processing of requests for closing or abandoning of an easement,
read on first and second reading on July 30th and August 6, 1980, respec-
tively, is hereby amended prior to third reading as follows:
"Section 49-13. Request for closing or abandonment of easement.
All persons desiring to have the City Council close or abandon
an easement shall file their request with the Director of
Engineering and Physical Development, in writing, directed to
the City Council. Such request shall contain an accurate des-
cription of the easements, or portions thereof, desired to be
closed or abandoned.
