CORPUS CHRISTI CITY CODE, 1976, BY AMENDING THE CHAF.GES FOR SERVICE FOR GARBAGE COLLECTION TO PRO- VIDE FOR AN INCREASE h rECTIVE WITH THE BILLINGS OF CYCLE ONE FOR THE MONTH OF SEPTEMBER, 1980; PROVIDING A SEVERANCE CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 21-18 of the Corpus Christi City Code, 1976, be amended, and the same is hereby amended to hereafter read as follows: "Section 21-18. Charges - For services to residences. The charges shown adjacent to the respective residential categories in the table immediately below shall be the charges for the collection services of the sanitation division and for the disposal services of the sanitation division. Minimum Charge Per Month or Fraction Thereof Type Description Collection Disposal Only (1) One family dwelling $ 5.30 $ 1.00 (2) Two family dwelling on one water and/or gas meter 10.60 2.00 (3) Two family dwelling on separate water and/or gas meters 5.30 each unit 1.00 ea. unit (4) Apartment 5.30 per unit 1.00 per unit (5) One family dwelling and single apartment on one water and/or gas meter 10.60 2.00 (6) Apartment house on one water and/or gas meter 5.30 per unit 1.00 per unit (7) Apartment house - ea. apart- ment on separate water and/or gas meter 5.30 per unit 1.00 per unit (8) Additional charge for rear door pickup on any type above 5.30 per unit SECTION 2. That Section 21-19 of the Corpus Christi City Code, 1976, be amended to hereafter read as follows: "Section 21-19. Same - To business and commercial establishments, etc. (a) The business and commercial institutions and all other occupied premises in the City of Corpus Christi for which the collection service of the sanitation division is available, except residences covered by Section 21-18 of this Code, shall be charged at a minimum rate of ten dollars and sixty cents ($10.60) per month for two (2) days per week pickup, or twenty-one dollars and twenty cents ($21.20) per month for four days per week pickup in the areas de - +r!" All charges above the minimum rates shall be 1_5699 determined by the superintendent; shall be reasonable; shall be determined by the type and amount of refuse, the location of the refuse and the number of pickups per week that are necessary to properly service and maintain sanitary conditions; and shall be not less than an amount proportional to the minimum charge provided in this article, said minimum charges being based on collection of one cubic yard of garbage per week. (b) All other businesses and commercial institutions and other occupied premises, except residences, shall be charged for the disposal ser- vices of the sanitation division at a minimum rate of one dollar and eighty cents ($1.80) per month for the first cubic yard or fraction thereof of trash and garbage per week, and an additional one dollar and eighty cents ($1.80) per month for each additional cubic yard or fraction thereof per week, based on the superintendent's estimate of the volume of -garbage and trash." SECTION 3. That Section 21-20 of the Corpus Christi City Code 1976, be amended to hereafter read as follows: "Section 21-20. Same - For garbage and trash from outside of the city. Charges for the disposal services of the sanitation division for garbage and trash from outside the city shall be as follows: (1) Residential: Two dollars ($2.00) per month per dwelling unit. (2) Other: Three dollars ($3.00) per month for the first cubic yard or fraction thereof per week, and an additional three dollars ($3.00) per month for each additional cubic yard or fraction thereof per week, based on the superintendent's estimate of the volume of garbage and trash. The charges for premises located outside the City for the collec- tion services of the Sanitation Division shall be 50% more than for premises located inside the City." Section 4. That Section 21-21 of the Corpus Christi City Code, 1976, be amended to hereafter read as follows: Section 21-21. Same - For large dead animals. A direct charge of twenty dollars ($20.00) shall be made at the time the service is required for the collection of any large dead animal." SECTION 5. That Section 21-21.1 of the Corpus Christi City Code, 1976, be amended to hereafter read as follows: "Section 21-21.1. Same - For demolition debris. • The charge for disposal services of the sanitation division for debris from demolition of buildings and structures shall be assessed on a project basis at the rate of forty-six cents ($0.46) per loose cubic yard, based on the volume estimated by the superintendent." SECTION 6. That this ordinance shall be effective with the billings of Cycle One for the month of September, 1980. SECTION 7. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
