HomeMy WebLinkAbout15700 ORD - 08/13/1980• AN ORDINANCE MAKING FINDINGS OF FACT; AMENDING SECTION 55-100 OF TRE CODE OF ORDINANCES, CITY OF CORPUS CHRISTI, 1976 REVISION, SO AS TO PROVIDE CERTAIN INCREASES IN WASTEWATER RATES; AMENDING SECTION 55-143, SUBSECTION (B), SO AS TO PROVIDE FOR AN INCREASE IN THE ABNORMAL SEWAGE SURCHARGE; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING AN EFFECTIVE DATE; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR PUBLICATION. WHEREAS, the last increase in normal sewage wastewater rates and the abnormal sewage surcharge was authorized by Ordinance No. 13860 and Ordinance No. 13859 respectively, passed and approved on August 3, 1977; and WHEREAS, the cost of providing wastewater treatment services has in- creased since that time and the City Council has studied such increases and it further appearing that materials and operating costs have increased at least 74%; and WHEREAS, the City Council finds that an increase in such wastewater rates is necessary to cope with the rising cost of such service to make such service more nearly self -supportive and thereby avoid a tax increase: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Section 55-100 of the Code of Ordinances, City of Corpus Christi 1976 Revision, be and the same hereby is amended by amending the schedule of rates and the rate schedule only thereof to hereafter read as follows: "SCHEDULE OF RATES BASED UPON WATER CONSUMPTION FOR WASTEWATER SERVICE CUSTOMERS WITH WASTEWATER CHAR- ACTERISTICS OF 250 PARTS PER MILLION OR LESS OF BIOCHEMICAL OXYGEN DEMAND, AND 250 -PARTS PER MILLION OR LESS OF SUSPENDED SOLIDS." Class Minimum One family Maximum Inside City Limits Outside City Limits $3.60 for first 2,000 gallons 9.84 $7.20 for first 2,000 gallons 19.68 The charges in addition to the above minimums, as well as the charge for all other sewer users, will be computed as cents per one thousand (1,000) gallons of water used as follows: 15700 • Cents Per 1,000 Gallons of Water Used Inside City Limits Each 1,000 gallons of water 48c Outside City Limits Each 1,000 gallons of water 96p" SECTION 2. That Section 55-143, Subsection (B) be and the same hereby is amended by amending the unit charges, and the unit charges only thereof, used to calculate the Abnormal Sewage Surcharge to hereafter read as follows: "S = V x 8.34 x .0324 x (B.O.D. - 250) and S= V x 8.34 x .0420 x (S.S. - 250) S = Surcharge in dollars for the billing period. V = Water consumption in millions of gallons during the billing period. 8.34 = Weight of water in pounds per gallon. .0324 = Unit charge in dollars per pound for B.O.D. .0420 = Unit charge in dollars per pound for suspended solids. B.O.D. = B.O.D. strength index in parts per million by weight. S.S. = Suspended solids stiength index in parts per million by weight. 250 = Normal B.O.D. and suspended solids strength in parts per million by weight." SECTION 3. A11 ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed to the extent of conflict herewith. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgement of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or pro- vision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given'full force and effect for its purpose. SECTION 5. The rates established by this ordinance shall be applied against all wastewater service provided beginning with Cycle 1 on or around August 1, 1980, and which shall be billed to customers beginning with Cycle 1 on or around September 1, 1980. SECTION 6. Publication shall be made one time in the official publica- tion of the City of Corpus Christi by publishing the caption of this ordinance, stating in substance the purpose of the ordinance.
