AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDMENT
TO THE CONTRACT WITH McCAUGHAN, ETHERIDGE & WEBB,
CONSULTING ENGINEERS, FOR ADDITIONAL ENGINEERING SER-
VICES TO BE PROVIDED IN CONNECTION WITH THE FABRICA-
TION AND INSTALLATION OF A STEEL DOME COVER AND INTERIOR
GAS MIXING EQUIPMENT FOR A PRIMARY DIGESTER AT THE WEST -
SIDE WASTEWATER TREATMENT PLANT (EPA PROJECT NO. C-48-
1217-03), THE EXECUTION OF WHICH IS SUBJECT TO APPROVAL
BY THE ENVIRONMENTAL PROTECTION AGENCY AND THE TEXAS
DEPARTMENT OF WATER RESOURCES; APPROPRIATING $12,150
OUT OF THE NO. 250 SANITARY SEWER BOND FUND, OF WHICH
$3,037.50 IS THE CITY'S LOCAL SHARE AND $9,112.50 IS THE
FEDERAL SHARE, APPLICABLE TO PROJECT NO. 250-77-18, WEST -
SIDE PLANT IMPROVEMENTS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:

SECTION 1. That the City Manager be authorized to execute an
amendment to the contract with McCaughan, Etheridge & Webb, consulting
engineers, for additional engineering services to be provided in connection
with the fabrication and installation of a steel dome cover and interior gas
mixing equipment for a primary digester at the Westside Wastewater Treatment
Plant (EPA Project No. C-48-1217-03), the execution of which is subject to
approval by the Environmental Protection Agency and the Texas Department of
Water Resources, a substantial copy of which amendment is attached hereto and
made a part hereof, marked Exhibit "A".
SECTION 2. That there is hereby appropriated $12,150 out of the
No. 250 Sanitary Sewer Bond Fund, of which $3,037.50 is the City's local share
and $9,112.50 is the federal share, applicable to Project No. 250-77-18,
Westside Plant Improvements.
SECTION 3. The necessity to amend the aforesaid contract and to
provide the sums hereinabove described in order that the project may continue
without delay creates a public emergency and an imperative public necessity
requiring the suspension of the Charter rule that no ordinance or resolution
shall be passed finally on the date of its introduction but that such ordi-
nance or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared that such emergency and necessity exist, and

passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO

AMENDMENT TO THE CONTRACT FOR OGINEERING SERVICES
THE STATE OF TEXAS J(
COUNTY OF NIECES
The City of Corpus Christi, hereinafter called "City", and McCaughan,
Etheridge & Webb, hereinafter called "Engineer", agree to the following amendment
to the contract for engineering services in connection with improvements to the
Westside Wastewater Treatment Plant, approved by the Corpus Christi City Council
on September 7, 1977, Ordinance No. 13934, and as subsequently amended.
1. The scope of work is amended to include providing engineering
services for the removal of the primary digester and its replacement with a new
steel cover, together with all internal gas mixing tubes, sandblasting and
painting, as a change order to the contract with Goolsby Construction Company_
2. The Engineer shall make preliminary investigations, prepare plans
and specifications, assist in negotiating and evaluating a change order proposal,
make structural engineering reviews of shop drawings, supervise construction in
accordance with the usual Step 3 requirements, provide resident inspection of the
work and make a recommendation as to final acceptance.
3. The City and the Engineer have negotiated the compensation for
these services, and have agreed to additional lump sum fees as shown on
Forms 5700-41 attached as'Exhibit "A", and as follows:
A. Design Services $ 2,800
B. Construction Supervision Basic Fee 2,870
C. Resident Inspection 6,080
D. Operating and Maintenance Manual 400
Total $12,150
4. It was and is hereby agreed that should the Environmental Protection
Agency rule these fees, or any part of them, to be ineligible, then the City will
pay the difference at its own cost.
5. It was and is hereby agreed that the City will release any retainage.
on engineering fees pertaining to the original construction contract when all work
not dependent on the digester dome cover completion has been completed.
Executed in duplicate, each of which shall be considered an original,

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
