HomeMy WebLinkAbout15709 ORD - 08/20/1980nh:8-19-80;lst AN ORDINANCE AMENDING ORDINANCE NO. 15285, PASSED AND APPROVED ON DECEMBER 26, 1979, WHICH ORDINANCE AUTHORIZED THE EXECUTION OF A WATER SUPPLY CONTRACT WITH THE CHAPMAN RANCH WATER SUPPLY CORPORATION, BY INCREASING THE MAXIMUM QUANTITY OF WATER WHICH MAY BE PURCHASED MONTHLY TO 4.5 MILLION GALLONS, ALL AS MORE PARTICU- LARLY SET FORTH IN THE CONTRACT, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 15285, passed and approved on December 26, 1979, which authorized the execution of a water supply contract with the Chapman Ranch Water Supply Corporation, be amended by increasing the maximum quantity of water which may be purchased monthly to 4.5 million gallons, all as more particularly set forth in the contract, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. The necessity to amend the aforesaid ordinance at the earliest practicable date in order to increase the maximum quantity of water which may be purchased monthly by the Chapman Ranch Water Supply Corporation creates a public emergency and an imperative public necessity requiring the sus- pension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the • date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .21, day of August, 1980. Quality and Quantity. City agrees to sell the Corporation at the point of delivery hereinafter specified, during the term of this contract or any renewal or extension thereof, potable treated water meeting applicable purity standards of the State Department of Health Resources in such quantity as may be required by the Corporation but limited to four and one-half (4.5) million gallons per month."
