AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT
WITH THE TEXAS JAll FESTIVAL SOCIETY FOR PRESENTATION OF
A FREE JAll FESTIVAL, A STAGE BAND COMPETITION AND FREE
BAND CLINICS ON JULY 4 AND JULY 5, 1981, ALL AS MORE
FULLY SET FORTH IN THE AGREEMENT, A SUBSTANTIAL COPY OF
WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED
EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be and he is hereby authorized
to enter into an agreement with the Texas Jazz Festival Society for presenta-
tion of a free jazz Festival, a stage band competition and free band clinics
on July 4 and July 5, 1981, all as more fully set forth in the agreement, a
substantial copy of which is attached hereto and made a part hereof, marked
Exhibit "A".
SECTION 2. The necessity to enter into the aforesaid agreement
at the earliest practicable date creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule that no ordinance
or resolution shall be passed finally on the date of its introduction but that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor having declared such emergency and necessity to
exist, and having requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction and take effect
and be in full force and effect from and after its passage, IT IS ACCORDINGLY
SO ORDAINED, this the 20 day of August, 1980.

AGREEMENT
THE STATE OF TEXAS
COUNTY OF NUECES
WHEREAS, the City of Corpus Christi is interested in bringing to
the citizens a major Jazz Festival, a high school stage band competition,
and band clinics, free to the public; and
WHEREAS. the Texas Jazz Festival Society has a program of providing
an annual Jazz Festival and related events free to the public; and
WHEREAS, the Texas Jazz Festival Society agrees to provide the
following program:
A. A Jazz Festival in Memorial Coliseum, free to the public,
on Sunday, July 5, 1981;
B. Stage band competition and free clinics on Saturday, July 4,
1981.
In consideration of the Texas Jazz Festival Society providing the
above and foregoing music program, the City of Corpus Christi agrees to pay
to the Texas Jazz Festival Society the sum of $6,000 for expenses of the
Festtval activities. Payment, however, is conditioned upon presentation to
the City by the said Jazz Festival Society of bills as they become due and
payable, signed by the Treasurer and one other designated officer of said
Jazz Festival Society. Expenses will be limited to fees and lodging for
bands or performers, promotion and printing for jazz musical activities
sponsored by the Jazz Festival Society and expenses for the Memorial Coliseum.
Provided, further, that said $6,000 may be applied to remaining
expenses from the 1980 festival to the extent that such expenses were authorized
to be paid with City funds. in the event that the Society repays to City $1.000
of said $6,000, then City agrees to consider a similar contract for $5,000 for
Society services in 1982.
The expenses for the free events at the Memorial Coliseum will be
the responsibility of the Texas Jazz Festival Society. As a co-sponsor of
the event, the City will, through the Park and Recreation Department, grant
a waiver of rental fees per se. The expenses of stage hands, labor, spotlights,
security, air conditioning, table and equipment rental will be the sole respon-
sibility of the Jazz Festival Society. If an event for which an admission fee
is charged is held at the Coliseum or at Exposition Hall the regular non-profit
organization rental fee is charged.
A full accounting of the revenue and expenses is to be made to the
City for the entire Texas Jazz Festival Society including any events held as
part of or in conjuction with the Texas Jazz Festival. This is to document
that the Festival to which the City contributes a payment is a totally non-
profit event.
Payments by the City will be made to the Society on request accom-
panied by statements for payment. A full financial accounting of the Festival
event is to be submitted to the Citywithin sixty (60) days of the closing of
the Society's fiscal year on August 31, or by October 31, 19EL.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
