STATUTES OF TEXAS AND APPLICABLE COMPETITIVE BIDDING PROVISIONS OF THE CITY CHARTER AND CODE WITH RESPECT TO CONTRACTS FOR THE REMOVAL OF BRUSH AND DEBRIS, FOR A PERIOD OF 90 DAYS FROM AND AFTER AUGUST 11, 1980; AND DECLARING AN EMERGENCY. WHEREAS, on the 9th and 10th days of August, 1980, Hurricane Alien hit Corpus Christi, Texas; and WHEREAS, on the 10th day of August, 1980, the City Council declared its finding of the existence of a natural disaster and declared a state of emergency by Ordinance No. 15682 duly passed and approved: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the operation of the competitive bidding require— ments of Article 2368a of the Revised Civil States of Texas and applicable competitive bidding provisions of the City of Corpus Christi Charter and Code of Ordinances with respect to contracts for the removal of brush and debris, is hereby removed for a period of 90 days from and after August 11, 1980; provided, however, that, insofar as practicable, bids, quotations; or estimates of material, labor and other costs for purchases, goods, works and the like described in Article 2368a or said Charter or Code, shall be diligentlysolicited and procured prior to entering into contract therefor, and such contract, if awarded, shall be made to the lowest and best bid, quotation or estimate received. SECTION 2. The necessity to remove the.operation of the competitive bidding requirements for the period of time as outlined above creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its &aMLi4Y! 15714 SEP Z 71984 • • introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 2.0 day of August, 1980.
