Home My WebLink About15715 ORD - 08/27/1980AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING ARTICLE 27. SUPPLEMENTARY HEIGHT, AREA, AND BULK REQUIREMENTS, SECTION 27-2, MODIFICATION OF HEIGHT REGULATIONS, BY ADDING A NEW SUBSECTION, 27-2.03, TO PRO- VIDE FOR WINDMILLS, WIND ENERGY CONVERSION SYSTEMS, AND WIND DRIVEN GENERATORS; KEEPING IN EFFECT ALL OTHER PRO- VISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH. WHEREAS, on February 26, 1980, after a public hearing regarding a proposed wind generator and tower, the Zoning Board of Adjustment recom- mended that the Zoning Ordinance be amended to specifically address wind energy conversion systems; and WHEREAS, on June 10, 1980. the Planning Commission recommended that the Zoning Ordinance, Section 27-2, Modification of Height Regulations, be amended by adding a new subsection dealing with windmills, wind energy conversion systems, and wind driven generators; and WHEREAS, on July 9, 1980, after a public hearing on the proposed amendment recommended by the Planning Commission, the City Council determined that the proposed amendment to the Zoning Ordinance should be amended to authorize the Zoning Board of Adjustment to approve or disapprove the installation of wind generators and towers under certain conditions; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would best serve the public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the changes hereinafter set out. 15715 Of1LMED SEP .471984 SECTION 2. That Article 27, SUPPLEMENTARY HEIGHT, AREA, AND BULK REQUIREMENTS, be and the same is hereby amended by amending Section 27-2, Modification of Height Regulations, by adding a new subsection, 27-2.03, to hereafter read as follows: "27-2.03 Windmills, wind energy conversion systems, and wind driven generators which exceed the height regulations prescribed in this ordinance are permitted as special exceptions if the Board of Adjustment finds, that in its opinion, as a matter of fact, such exceptions will not substantially affect adversely the uses of adjacent and neighboring property permitted by this ordinance." SECTION 3. That all ordinances or parts of ordinances in con- flict herewith are hereby expressly repealed. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance.
