HomeMy WebLinkAbout15717 ORD - 08/27/1980, . • 0 AN ORDINANCE CLOSING AND ABANDONING THE 10' WIDE UTILITY EASEMENT EXTENDING ACROSS THE HARBOR VILLAGE SUBDIVISION, A MAP OF WHICH IS RECORDED IN VOLUME 45, PAGES 164, 165, MAP RECORDS OF NUECES COUNTY, TEXAS, AS MORE FULLY DESCRIBED HEREINAFTER; PROVIDING FOR SEVERABIL- ITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10' wide utility easement extending across the Harbor Village Subdivision, as recorded in Volume 45, Pages 164, 165, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described 10' wide utility easement extending across the Harbor Village Subdivision, as recorded in Volume 45, Pages 164, 165, Map Records, Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, said easement being described as follows: FIELDNOTES for the abandonment of an existing 10.00 foot wide utility easement crossing through Harbor Village, a map of which is recorded in Volume 45, Pages 164, 165, Map Records of Nueces County, Texas; said 10.00 foot utility easement recorded in Vol- ume 264, Page 496, Deed Records of Nueces County, Texas: BEGINNING at a point on the Northwest subdivision line of said Harbor Village for the West corner of this easement from which corner the West corner of Lot 15, Block 2 of said Harbor Village bears South 29°01'23" West 12.92 feet; THENCE North 29°01'23" East, along the Northwest subdivision line of Harbor Village, with the Northwest boundary line of said Lot 15, 10.54 feet for the North corner of this easement; THENCE South 79°26'00" East 582.28 feet to a point on the South- east subdivision line of said Harbor Village for the South corner of Lot 1, Block 3 of said Harbor Village and the East corner of this easement; THENCE South 29°00'00" West, along the Southeast subdivision line of Harbor Village, 10.54 feet for the South corner of this easement; THENCE North 79°26'00" West 582.28 feet to the PLACE OF BEGINNING. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, ED 15 717 SEP 2 71984 • word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 2'f day of 1980.
