HomeMy WebLinkAbout15726 ORD - 08/27/1980nh:8-2/-80;1st .. • AN ORDINANCE CLOSING AND ABANDONING THREE SMALL PORTIONS OF MARGUERITE STREET AT 21ST STREET IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, RESERVING THE NECESSARY EASEMENTS FOR EXISTING UTILITIES; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of three small portions of Marguerite Street at 21st Street, in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known addresses of the owners of pro- perty abutting the area to be closed and within 450 feet of the area to be closed, and thereafter, pursuant to said notice, public hearing was held at regular Council Meeting by the City Council of the City of Corpus Christi on August 20, 1980, in accordance with the provisions of the City Charter; and WHEREAS, it has been determined by the City Council after such hearing that the portions of Marguerite Street at 21st Street, proposed to be closed, are not needed now, nor will they be within the foreseeable future needed as public streets or public alleys and that it would best serve the public convenience and necessity to close the portions of Marguerite Street at 21st Street subject to retention by the City of Corpus Christi of the necessary easements for existing utilities, as more particularly described hereinafter: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter described portions of Marguerite Street at 21st Street, situated in the City of Corpus Christi, Nueces County, Texas, be and the same are hereby closed for public use and abandoned to the owners of the abutting property, save and except for those portions of the easements hereinafter described that are retained for utility easements: Parcel 1 Lamar School Area Street Improvements - Phase II Being an irregularly shaped tract of land out of the Marguerite Street right of way and being south of and adjacent to Lots 1 and 2, Block 13, Patrick Webb Addition, as shown by map of record in Volume A, Page 13, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: 5'72,6 MIGaiFJLMED SSP 2 71884 • Beginning at the southwest corner of said Lot 2, Block 13 for the beginning point of this tract; Thence N. 88° 30' 00" E. along the northerly right of way of said Marguerite Street a distance of 49.00 ft. to a point said point being on the southern boundary line of Lot 1; Thence S. 1° 30' 00" E. a distance of 7.94 feet to a point; Thence S. 76°34' 18" W. a distance of 24.53 feet to a point; Thence S. 60°54' 00" W. a distance of 28.21 feet to a point; Thence N. 1° 30' 00" W. a distance of 26.08 feet to the point of beginning, and containing 0.017 Acres, more or less. Parcel 2 Lamar School Area Street Improvements - Phase II Being an irregularly shaped tract of land out of the Marguerite Street right of way and being south of and adjacent to Lots 3 and 4, Block 13, Patrick Webb Addition, as shown by map of record in Volume A, Page 13, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at the southwest corner of said Lot 4, Block 13 for the beginning point of this tract; Thence N. 88° 30' 00" E. along the northerly right of way of said Marguerite Street a distance of 54.30 feet to a point, said point being the southeast corner of said Lot 3; Thence S. 1° 30' 00" E. a distance of 26.08 feet to a point; Thence S. 60° 54' 00" W. a distance of 27.21 feet to a point; Thence S. 70° 29' 56" W. a distance of 31.74 feet to a point on the east boundary line of Lot 60, Block 6, Steele's Addition; Thence N. 1° 30' 00" W. along said west boundary of Lot 60 a distance of 48.50 feet to the point of beginning, and containing 0.048 acres, more or less. Parcel 3 Lamar School Area Street Improvements - Phase II Being a triangularly shaped tract of land out of the Marguerite Street right of way and being north of and adjacent to Lots 5 and 6, Block 12, Patrick Webb Addition, as shown by map of record in Volume A, Page 13, Map Records, Nueces County, Texas, and more particularly described by metes and bounds as follows: Beginning at the Northeast corner of said Lot 6, Block 12 for the beginning point of this tract; Thence S. 88' 00' 00" W. along the south right of way line of said Marguerite Street a distance of 31.47 feet to a point for a corner; Thence N. 60° 24' 00" E. a distance of 35.51 feet to a point on the west boundary line of Lot 7, Block 12, • • Patrick Webb Addition for a corner of this tract; Thence S. 2° 00' 00" E. along the west boundary line of said Lot 7 a distance of 16.45 feet to the point of beginning, and containing 0.0059 acres, more or less. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid portions of Marguerite Street at 21st Street creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from ifterl! passage, IT IS ACCORDINGLY SO ORDAINED, this the 27 day of U , 1980.
