YOUNG CONSTRUCTION COMPANY FOR THE CONSTRUCTION OF THE SECOND PHASE OF IMPROVEMENTS TO THE BROADWAY WASTEWATER TREATMENT PLANT, EPA PROJECT NO. C-48-1216-05, SUBJECT TO CONCURRENCE AND APPROVAL FROM THE TEXAS DEPARTMENT OF WATER RESOURCES AND THE ENVIRONMENTAL PROTECTION AGENCY; APPRO- PRIATING $3,550,000 OUT OF THE NO. 250 SANITARY SEWER BOND FUND, OF WHICH $3,437,267 IS FOR THE CONSTRUCTION CONTRACT AND $112,733 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES, APPLICABLE TO PROJECT NO. 250-77-22, BROADWAY WASTEWATER TREATMENT PLANT IMPROVEMENTS, PHASE 2 EXPANSION; AND DECLAR- ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with W. T. Young Construction Company for the construc- tion of the second phase of improvements to the Broadway Wastewater Treatment Plant, EPA Project No. C-48-1216-05, subject to concurrence and approval from the Texas Department of Water Resources and the Environmental Protection Agency, all as more fully described in the plans and specifications and con- tract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of W. T. Young Con- struction Company opened on July 16, 1980, said bid being the lowest and most advantageous to the City of Corpus Christi. SECTION 2. That there is hereby appropriated the sum of $3,550,000 out of the No. 250 Sanitary Sewer Bond Fund, of which $3,437,267 is for the construction contract and $112,733 is for contingencies and incidental expenses, all applicable to Project No. 250-77-22, Broadway Wastewater Treatment Plant Improvements, Phase 2 Expansion. SECTION 3. That the necessity to execute the aforesaid contract and to appropriate the sums•hereinabove set forth so that construction may commence at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency 15741 ii . r l Li AWL 'SEP 271984. • �. • and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .2264 day of September, 1980.
