AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AMENDMENT
NO. 1 TO GRANT AGREEMENT, PROJECT NO. 6-48-0051-05,
CONTRACT NO. DOT-FA-76SW-8100, WITH THE DEPARTMENT
OF TRANSPORTATION, FEDERAL AVIATION ADMINISTRATION,
SO AS TO DELETE PARCELS NUMBERED 3 AND 4 FROM THE
AIRPORT DEVELOPMENT PARAGRAPH OF THE GRANT AGREE-
MENT AND TO ADD PARCEL 14A, AS MORE FULLY SET
FORTH IN THE AMENDMENT AND RESOLUTION, A SUBSTAN-
TIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A
PART HEREOF, MARKED EXHIBIT "A"; RESOLVING TO
CONDEMN OR PURCHASE PARCELS 3 AND 4 IN THE EVENT
A USE POSING A SAFETY HAZARD TO THE AIRPORT IS
PROPOSED; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute Amendment
No. 1 to Grant Agreement, Project No. 6-48-0051-05, Contract No. DOT-FA-76SW-8100,
with the Department of Transportation, Federal Aviation Administration, so as
to delete parcels numbered 3 and 4 from the airport development paragraph of
the Grant Agreement and to add Parcel 14A, all as more fully set forth in the
said Amendment No. 1, a substantial copy of which is attached hereto and made
a part hereof. In the event a proposed use poses a safety hazard to the
Airport in the future, the City will resolve the matter through condemnation
or purchase of Parcels 3 and 4.
SECTION 2. The necessity to authorize execution of the aforesaid
Amendment at the earliest practicable date creates a public emergency and
an imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction but that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor, having declared that
such emergency and necessity exist, having requested the suspension of the
Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the (0 day of September,

AMENDMENT NO. 1 TO GRANT AGREEMENT
WHEREAS, the Federal Aviation Administration (hereinafter
referred to as the "FAA") has determined it to be in the interest
of the United States that the Grant Agreement between the FAA,
acting for and on behalf of the United States, and the City of
Corpus Christi, Texas (hereinafter referred to as the "Sponsor"),
accepted by said Sponsor on September 29, 1976, be amended as
hereinafter provided.
NOW THEREFORE, WITNESSETH:
That in consideration of the benefits to accrue to the parties
hereto, the United States of America on the one part, and the
Sponsor on the other part, do hereby mutually agree that the said
Grant Agreement shall be and hereby is amended:
1. To delete the parcels numbered 3 and 4 from the airport
development paragraph of page 1 of the Grant Agreement and
add parcel 14A, and the new amended Grant Agreement is
therefore revised to read as follows:
Acquire land, fee simple title, to parcels A, B, C, 2, 5
and 14A, as shown on property map Exhibit "A", or•other
property interests satisfactory to the Administrator.
2. It is mutually understood and agreed by both parties that
the original property map Exhibit "A", dated September,
1976, attached to the Project Application for this project
is hereby deleted and the Exhibit "A" revised August 22,
1979, and attached hereto, is incorporated into the said
Project Application and Grant Agreement for all purposes.

IN WITNESS WHEREOF, the parties hereto have caused this Amend-
ment to said Grant Agreement to be duly executed.

That I have examined the foregoing Amendment to Grant Agree-
ment and the proceedings taken by said Sponsor relating thereto
and find that.the execution thereof by said Sponsor has been duly
authorized and is in all respects due and proper and in accordance
with the laws of the State of Texas, and further, in my opinion,
said Amendment to Grant Agreement constitutes a legal and binding
obligation of the Sponsor in accordance with the terms thereof.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
