HomeMy WebLinkAbout15753 ORD - 09/10/1980.4 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH BACKHOE LEASE SERVICE, INC. FOR INSTALLATION OF A STORM DRAINAGE SYSTEM IN THE ANNAVILLE ROAD & LEONARD DRIVE AREA OF THE CITY; APPROPRIATING $66,000 OUT OF THE NO. 295 STORM SEWER BOND FUND, OF WHICH $59,717 IS FOR THE CONSTRUCTION CONTRACT AND $6,283 IS FOR CONTINGENCIES, INCIDENTAL AND RELATED EXPENSES, APPLICABLE TO PROJECT NO. 295-77-8, ANNAVILLE ROAD & LEONARD DRIVE EXTENSION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: • SECTION 1. That the City Manager be and he is hereby authorized to execute a contract with Backhoe Lease Service, Inc. for installation of a storm drainage system in the Annaville Road and Leonard Drive area of the City, all as more fully described in the plans and specifications and contract documents on file in the office of the City Secretary, all of which are made a part hereof by reference and according to the bid of the Backhoe Lease Service, Inc. opened on September 3, 1980, said bid being the lowest and most advantageous to the City of Corpus Christi. SECTION 2. That there is hereby appropriated the sum of $66,000 out of the No. 295 Storm Sewer Bond Fund, of which $59,717 is for the construction con- tract and $6,283 is for contingencies, incidental and related expenses, applicable to Project No. 295-77-8, Annaville Road and Leonard Drive Extension. SECTION 3. That the necessity to execute the aforesaid contract and to appropriate the sums hereinabove set forth so that construction may be commenced at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 1D day of September, 1980. FIN 2-55 Revised 7/31/69 Corpus Christi, Texas /0 day of 0 • TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
