HomeMy WebLinkAbout15756 ORD - 09/10/1980• 1p :9-9-80;1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A CHANGE ORDER TO THE AGREEMENT BETWEEN THE CITY OF CORPUS CHRISTI AND GIBRALTAR SAVINGS, DEVELOPER OF THE OVERLAND MEADOWS SUBDIVISION, UNIT 2, A SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHBIT "A", WHICH PROVIDES FOR AN ADDITIONAL 50 LINEAR FEET OF 36 -INCH DIAMETER STORM SEWER AND AN INLET STRUCTURE; APPROPRIATING $2,450 OUT OF THE NO. 295 STORM SEWER BOND FUND, APPLICABLE TO PROJECT NO. 295-72-17, OVERLAND MEADOWS SUBDIVISION, UNIT 2; AND DECLARING AN EMERGENCY. • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute a change order to the agreement between the City of Corpus Christi and Gibraltar Savings, developer of the Overland Meadows Subdivision, Unit 2, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A", which provides for an additional 50 linear feet of 36 -inch diameter storm sewer and an inlet structure. SECTION 2. That there is hereby appropriated the sum of $2,450 out of the No. 295 Storm Sewer Bond Fund, applicable to Project No. 295-72-17, Overland Meadows Subdivision, Unit 2. SECTION 3. The necessity to authorize the execution of the afore- said change order and to appropriate the sums set forth hereinabove at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the i49 day of September, 1980. To avoid a continual silting and erosion problem in the large drainage ditch between Overland Meadows Unit II and Westwood Reights How can similar changes be avoided in the future?
