HomeMy WebLinkAbout15766 ORD - 09/17/1980• 1p:9/15/80:1st TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ACCEPT MAINTENANCE AGREEMENTS FROM THE FIRST NATIONAL BANK OF FLOUR BLUFF FOR MEDIAN MAINTENANCE IN FIRST NATIONAL BANK BOULEVARD AND FROM MARK BRATTON FOR MEDIAN MAIN- TENANCE IN SUNBURST DRIVE, BEING IN LAGUNA BUSINESS CENTER, MARKED, RESPECTIVELY, EXHIBIT "A" AND EXHIBIT "B"; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPU CHRISTI, SECTION 1. That the City Manager be authorized to acce t main- tenance agreements from the First National Bank of Flour Bluff for median maintenance in First National Bank Boulevard and from Mark Bratton for median maintenance in Sunburst Drive, being in Laguna Business Center, a substantial copy of each agreement being attached hereto and marked, res- pectively, Exhibit "A" and Exhibit "B". SECTION 2. The necessity to authorize acceptance of the aforesaid maintenance agreements at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of that City Council, and the Mayor having declared that such emergency and necessity exist, having requested the sus- pension of tine Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and'ieffect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the j 1 day of September, 1980. NOW,' -THEREFORE, the City and the Developer agree as follows: _ 1. The Developer will construct a median island approximately 225 L.F. in length in First National Boulevard Drive, contiguous to South Padre Island Drive, per attached EXHIBIT "A". 2. The Developer will maintain all of the surface area of the .island shown in EXHIBIT "A", and will grade, mow, plant, landscape, irrigate and/or otherwise assume full responsibility for caring for aad preserving planting materials of all types which may be placed in the island by Developer, to include a regular maintenance program. Signs will not be erected within the island, nor will the island be totally paved with asphalt, concrete, tile, brick -or similar materials without the written approval of the City. 3. This Agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors, and assigns. N.B. /I p GG:�2r MAINTENANCE AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES Il This agreement is authorized by Ordinance No. and is entered into between the City of Corpus Christi, Texas and M•rk Bratton, hereinafter called "Abutting Owner" and pertains to the perpetual m•intenance of two median islands and a portion of a third median island, with all islands being south of the south right-of-way line of South Padre Island Drive at Sunburst Drive in Laguna Business Center. NOW THEREFORE, the City and the Abutting Owner agree as follows: 1. The Abutting Owner will maintain two islands and a .ortion of a third median island in Sunburst Drive, as shown on the attached E IBIT "A". 2. The Abutting Owner will maintain all of the surface area of the islands shown in EXHIBIT "A" and will grade, mow, plant, landsc pe, irri- gate and/or otherwise assume full responsibility for caring for and preserving planting materials of all types which may be placed in the islands y Abutting Owner, to include a regular maintenance program.
