Mayor Rhodes called the meeting to order in the Council Chambers of City Hall.
City Secretary Chapa called the roll and verified that the necessary quorum of the Council
and the required charter officers were present to conduct the meeting.
Mr. Chapa pointed out that he had placed before the Council members copies of a letter from
five citizens requesting reconsideration of Ordinance 022679, which was approved by the Council
on September 10, 1996. The ordinance appropriated $4.8 million from the unappropriated fund
balance of the Combined Utilities System Fund to use as an advance for preliminary costs of the
Lake Texana pipeline project.
Mayor Rhodes asked which citizens had requested the reconsideration. Mr. Chapa replied
that they were Mr. J.E. O'Brien, Mr. G. Lewis Lovelace, Mr. R.F. Hasker, Mr. Neal Trolinger, and
Mr. Albin J. Kucera. He said he has asked City Attorney Bray for an opinion as to whether this
meets the initiative and referendum requirements set out in the City Charter. Mr. Chapa said Mr.
Bray was not in town that day and would provide a response later.

Mayor Rhodes announced the closed session, pursuant to Texas Government Code Section
551.074, regarding new City Manager selection, including candidates' interviews and other matters
related to selection, with possible action thereafter in open session.
The Mayor added that since the Council will be conducting City Manager interviews in
executive session, and that is the only business before the Council that day, the remainder of the

meeting would not be televised.
The Council went into closed session. (*Council Member McNichols arrived during the
closed session.)
The Council returned from closed session.
Mayor Rhodes stated that the Council had interviewed three well-qualified and competent
individuals for the position of City Manager. The Council had requested that Mr. Norman Roberts,
the search consultant, bring one or two additional candidates for consideration before they make their
final decision.
There being no further business to come before the Council, Mayor Rhodes declared the
Council meeting adjourned at 4:50 p.m. on September 17, 1996.
