AN ORDINANCE
AUTHORIZING AMENDMENT TO AN AGREEMENT WITH ANNIE
BLAKE MORGAN HEAD, DEVELOPER OF A"21.22 -ACRE TRACT
AT THE SOUTHWEST CORNER OF LEOPARD STREET AND
RAND MORGAN ROAD, SAID AGREEMENT PREVIOUSLY APPROVED
BY ORDINANCE NO. 15524, PROVIDING FOR CHANGE OF
AGREEMENT TERMINATION DATE FROM OCTOBER 1, 1980 TO
JANUARY 2, 1981, SAID AGREEMENT RELATING TO ULTIMATE
DRAINAGE IMPROVEMENT, A SUBSTANTIAL COPY OF THE SAID
AMENDMENT TO AGREEMENT BEING ATTACHED HERETO AND MADE
A PART HEREOF, MARKED EXHBIT "A"; AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That authorization is hereby given for execution of

an amendment to agreement with Annie Blake Morgan Head, developer of a
21.22 -acre tract at the southwest corner of Leopard Street and Rand Morgan
Road, said agreement previously approved by Ordinance No. 15524, providing
for change of agreement termination date from October 1, 1980 to January 2,
1981, said agreement relating to ultimate drainage improvement, a substantial
copy of the said amendment to agreement being attached hereto and made a part
hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize execution of the aforesaid
amendment to agreement at the earliest practicable date creates a public
emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution shall
be read at three several meetings of the City Council, and the Mayor having
declared that such emergency and necessity exist, having requested the
suspension of the Charter rule and that this ordinance be passed finally on
the date of its introduction and take effect and be in full force and effect
from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the e2/

AMENDMENT TO AGREEMENT

Reference is made to the Agreement dated May 9, 1980,
between the City of Corpus Christi, a municipal corporation,
therein and herein called "City", and Annie Blake Morgan Head,
Individually, and as Trustee for the Randolph Blake Farenthold
Trust and the Sue Cleveland Farenthold Trust under the will of
Randolph Farenthold, and as Trustee of the Morgan -Randolph
Blake Farenthold Trust and the Morgan -Sue Cleveland Farenthold
Trust, therein and herein called "Landowner", relating to
drainage improvements along Rand Morgan Road, the grant of an
easement by Landowner to City for such purpose and the payment
by Landowner to City of the sum of money therein provided.
In consideration of the premises and the mutual covenants
and agreements of the parties, City and Landowner have agreed,
and hereby agree, that the above described agreement dated May
9, 1980, shall be amended by substituting the date January 2,
1981, for the date October 1, 1980, in paragraph numbered (4)
of said agreement to the same intent and effect as if the date
January 2, 1981 had been originally provided therein. '
EXECUTED in duplicate, each copy of which shall be con-
sidered an original, on this 10th day of September, 1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
