HomeMy WebLinkAbout15817 ORD - 10/08/1980AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION' RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF GREENWOOD FOREST ITD AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PART OF LOT 8; SECTION 7. BOHFMIAN COIONY IAND MORF FULLY DESCRIBED HEREINAFTER. SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "I-2" LIGHT -INDUSTRIAL DISTRICT TO "R -1B" ONE -FAMILY DWELLING DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Greenwood Forest LTD. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday. October 8, 1980 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided 'by the City Council that to'approve the hereinafter Set 4forth'amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the'City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record • in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. - 6c8- 1 7 ]QFILMEI. up 271994 SFCTIGN 2. That the zoning of the hereinafter more fully described portion of Lot 8, Section 7, Bohemian Colony Lands, situated in the City of Corpus Christi, Nueces County, Texas, be and the 'same is hereby changed from "I-2" Light Industrial District to "R -1B" One -Family Dwelling District. Being a tract or parcel containing 14.25 acres of land out of Lot 8, Section 7, Bohemian Colony Land, a map of which is recorded in Volume A, Page 48, Map Records of Nueces County, Texas: BEGINNING at a point on the Southwest right-of-way line of the N.A.S. railroad right-of-way (40.00 feet wide) for the North corner of this tract from which corner the North corner of said Lot 8 bears North 61°34'15" West 264.00 feet to a point on the centerline of Greenwood Drive, same being the Northwest boundary line of said Lot 8, and with said centerline North 29°00'00" East 20.00 feet; THENCE South 61°34'15" East, with the Southwest right-of-way line of the N.A.S. railroad right-of-way, parallel with the center- line thereof and 20.00 feet distant therefrom, measured at right angles thereto, 750.00 feet, more or less, for the East corner of this tract; THENCE leaving said railroad right-of-way, South 28°25'45" West 275.00 feet, more or less, for a corner of this tract; THENCE North 61°34'15" West 190.00 feet, more or less, for an inside corner of this tract; THENCE South 29°00'00" West 540.00 feet, more or less, for the South corner of this tract; THENCE North 61°00'00" West 116.00 feet for an inside corner of this tract; THENCE South 29°00'00" West 31.06 feet for a corner of this survey; THENCE North 61°00'00" West 60.00 feet for a corner of this tract and the point of curvature of a circular curve to the left whose radius point bears North 61°00'00" West 10.00 feet and has a central angle of 90°00'00", a radius of 10.00 feet, a tangent dis- tance of 10.00 feet and an arc length of 15.71 feet; THENCE with said curve to the left 15_71 feet for the point of tangency; THENCE North 61°00'00" West 590_00 feet for a point of curva- ture of a circular curve to the left which has a central angle of 90°00'00", a radius of 10_00 feet,,a tangent distance of 10.00 feet and an arc length of 15.71 feet; THENCE with said curve to the left, 15.71 feet for the point of tangency on the Southeast right-of-way line of Greenwood Drive for a corner of this tract; THENCE North 61°00'00" West 40.00 feet to a point on the origi- nal centerline of said Greenwood Drive, same being the Northwest boundary line of said Lot 8 for the West corner of this tract; THENCE North 29°00'00" East, with said centerline, along the Northwest line of Lot 8, 444.00 feet for a corner of this tract; THENCE South 61°00'00" East, at 40.00 feet pass said Southeast right-of-way line of Greenwood Drive, in all a distance of 264.00 feet for an inside corner of this tract; THENCE North 29°00'00" East 447.34 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances•or-parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc— tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension .of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, nn IT IS ACCORDINGLY SO ORDAINED, this the d day of 19 Y0 ATTEST: .
