AN ORDINANCE
APPROVING THE EXTENSION OF THE CONCESSION CONTRACT
WITH.MARGIE BENNETT dba COLISEUM CONCESSIONS,GRANT-
ING SAID EXTENSION OF THE RIGHTS OF CONCESSION AT THE
EXPOSITION HALL AND 'MEMORIAL COLISEUM ON SHORELINE
BOULEVARD IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS, FROM OCTOBER 31, 1980 THROUGH JANUARY 5,
.1981, UNDER THE SAME TERMS AND CONDITIONS AS GRANTED
BY ORDINANCE NO. l4013,.PASSED AND APPROVED BY THE
CITY COUNCIL ON NOVEMBER 9, 1977, EXCEPT THAT THE PER-
CENTAGE OF SALES OF BASIC ITEMS PAID TO THE CITY BE SET
AT 25% DURING THE PERIOD OF THE EXTENSION, ALL AS MORE
FULLY SET FORTH IN THE EXTENSION AGREEMENT, A SUBSTANTIAL
COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF,
MARKED EXHIBIT "A"; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:

SECTION 1. That the concession contract granted by the City of
Corpus Christi to Margie Bennett dba Coliseum Concessions by authority of
Ordinance No. 14013, passed and approved on November 9, 1977, for rights
of concession at the Exposition Hall and Memorial Coliseum on Shoreline
Boulevard, be and the same is hereby extended from October 31, 1980 through
January 5, 1981, under the same terms and conditions except that subssectioos
(A), (C) and (D) of Paragraph VII reflect a change of percentage on sales of _
basic items paid to the City from 43%-23% to 25% during the period of the

extension, all as more fully set forth in the Extension Agreement,.a substan-
tial copy of which is attached hereto and made a part hereof, marked Exhibit A.
SECTION 2. The necessity to authorize the aforesaid extension of
concession grant at the earliest practicable date creates a public emergency
and an imperative public necessity requiring the suspension of the Charter
rule that no ordinance or resolution shall be passed finally on the date
of its introduction but that such ordinance or resolution shall be read at
,
three several meetings of the City Council, and the Mayor having declared that
such emergency and necessity exist, having requested the suspension of the
Charter rule and that this ordinance be passed finally on the date of its
introduction and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the 15th day of October, 1980.

EXTENSION AGREEMENT
THE STATE OF TEXAS Q
COUNTY OF NUECES
WHEREAS, by authority of Ordinance No. 14013, passed and approved
on November 9, 1977, a contract granting concession rights at the Exposition
Hall and Memorial Coliseum to Margie Bennett dba Coliseum Concessions was
entered into by and between the City of Corpus Christi and Margie Bennett,
said concession rights commencing on November 1, 1977 and terminating on
October 31, 1980; and
WHEREAS, the concessionaire has requested extension of the contract
until January 5, 1981, and the City Council is agreeable to such extension:
NOW, THEREFORE, in consideration of the premises and for and in
consideration of the agreements contained herein, the parties hereto do
hereby agree as follows:
The parties mutually agree that the concession contract, as extend-
ed and amended hereby, entered into between the parties be and the same is
hereby continued until January 5, 1981, and the terms and conditions of said
contract entered into by authority of Ordinance No. 14013 are continued ex-
cept as herein provided.

That subsections (A), (C) and (0) of Paragraph VII be amended
to hereafter provide as follows:
(A) 25% of gross sales on all basic concession items sold,
including all drinks, ice, peanuts, popcorn, cotton candy and sno-cones.
Those items listed in (B), (C) and (D) below, shall carry the respective
percentages shown.
(C) 25% of gross sales on food items including: chipos, dough-
nuts, potato chips, pretzels, sandwiches, hot dogs, french fries, chili
dogs, tamales, coffee, barbecue, salted peanuts and pizza.
(0) 25% of all gross sales of items listed below:

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
