WITH NOLAN CULP, DEVELOPER OF BROOKHAVEN ANNEX, LOT D,
PROVIDING FOR THE CITY'S SHARE OF CONSTRUCTION COSTS
OF AN OVERDEPTH OFF-SITE SANITARY SEWER EXTENSION TO
THE, SUBDIVISION, A SUBSTANTIAL+COPY OF WHICH AGREEMENT
IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED

SECTION 2. That there.is, hereby appropriated the sum of $1,530.18
out of the No. 250 Sanitary Sewer Bond Fund for payment to NolanoCulp upon

completion by the developer and acceptance of the subdivision by the City,
applicable to Project No. 250-77-12.3, Brookhaven Annex, Lot D, overdepth. ,..
SECTION 3. The necessity to authorize execution of the aforesaidr a
agreement and the appropriation of the sums set forth in order that the off -

. site sanitary sewer extension may be completed at the earliest possible'date °

creates a public emergency, requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its intro-
duction and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor, having declared that such emer-
gency and necessity exist, having requested the suspension of the Charter rule
and that this ordinance be passed finally on the date of its introduction and
take effect from and after its passage, IT IS ACCORDINGLY SO,ORDAINED, this

AGREEMENT
THE STATE OF TEXAS
COUNTY OF NUECES X
This agreement is entered into by and between the City of Corpus
Christi, Texas, a municipal corporation, hereinafter called "City", and Nolan
Culp, Owner, hereinafter referred to as "Developer", and pertains to the City's
share of the cost for improvements when City participation is set forth in the
Platting Ordinance and for improvements required by the City over and above
those set forth in the Platting Ordinance in the development of Brookhaven
'Annex, Lot D.
NOW, THEREFORE, for and in consideration of the mutual covenants
and conditions herein exchanged and agreed to be kept and performed the City
and Developer agree as follows:
1. The Developer has constructed an 8" vitrified clay sewer line
along the western boundary of Bookhaven Subdivision from the south right—of—way
line of Hearne Road southerly to station 9+34. This construction was contracted
for and financed by the Developer.
2. The City agrees to reimburse the Developer as its share for the
cost of the above stated construction the sum of One Thousand Five Hundred
Thirty and 18/100 Dollars ($1,530.18). Such reimbursement will be made by the
City to Developer upon execution of this agreement.
3. The Developer agrees to indemnify the City against any claims
arising as a result of the project.
