HomeMy WebLinkAbout15823 ORD - 10/15/1980- AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,• APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED UPON APPLICATION OF SMICON, INC. AND MR. A.K. ADAMS BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT A, BEING OUT OF BLOCK 9, J.C. RUSSELL FARM BLOCKS AND TRACT B ALSO BEING OUT OF BLOCK 9, J.C. RUSSELL FARM BLOCKS, BEING MORE FULLY DESCRIBED HEREINAFTER, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "B-4" GENERAL BUSINESS DISTRICT AND "A-1" APARTMENT HOUSE DISTRICT. T0 "I-2" LIGHT INDUSTRIAL DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Smicon, Inc. and Mr. A.K. Adams for amendment to the zoning map of the City of Corpus Christi;' WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday, October 15, 1980 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. lids ds I : i 15823 SIP 271984 SECTION 2. That the zoning of Tracts A and B, being a portion of Block 9, J.C. Russell Farm Blocks, situated inithe City of Corpus Christi, Nueces County, Texas be and the same is hereby changed from "B-4" General Business District and "A-1" Apartment House District to "I-2" Light Industrial•District, said Tracts A & B being more fully described as follows: TRACT A This tract is a portion of Block 9 of the partition of the J. C. Russell Farm Blocks as recorded in Volume 28 at pages 58 and 59, Map Records of Nueces County, Texas. Beginning at a point in the proposed east line of Navigation Boulevard, a 100 -foot -wide street, said point being 50 feet from and at right angles to the centerline of the original 40 -foot roadway as dedicated in Volume 3, at Page 53, Map Records of Nueces County, Texas; said point being North 527.01 feet from the northwest corner of Johns Industrial Subdivision as recorded in Volume 30 at Page 1, Map Records of Nueces County, Texas; Thence: North 699.70 feet to the north line of said Block 9; Thence: East with the north line of said Block 9, a distance of 1524.69 feet; Thence: South a distance of 699.70 feet; Thence West a distance of 1524.69 feet to the place of beginning. , This tract contains 24.491 acres of land. TRACT B A tract of land containing 22.571 acres being out of Tract 3 Blcck 9, J. C. Russell Farm Blocks as per attatchment. Starting at a point in the proposed east line of Navigation Boulevard. a 100 foot wide street, said point being 50 feet from the centerline of the origional 40 foot wide roadway said point being -527.01 feet from the northwest corner of Johns Industrial Subdivision as recorded in Volume 30 at page 1 tap of Records of Nueces County, Texas. Thence East 1524.69 feet; Thence: South 730.01 feet; Thence: West 576.87 feet; Thence: North 51 degrees 36'25" - West 326'87" Thence; West 511'63" Thence: North 527.01 feet to starting point. This tract contains 22.571 acres of land. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August,'1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances•or-parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid ,change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 15th day of October 19 80 .
