AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMOT WITH
CLOWER INTERESTS, DEVELOPERS OF LA JOYA SUBDIVISION,
'PROVIDING FOR PAYING THE CITY $30,000 FOR THE PRIVILEGE
OF UTILIZING A CITY -CONSTRUCTED OFF-SITE STORM SEWER AND
PROVIDING FOR THE DEDICATION OF RIGHT-OF-WAY OF MARTIN
STREET, ALL AS MORE FULLY SET FORTH IN THE AGREEMENT, A ,.
SUBSTANTIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A
PART HEREOF, MARKED EXHIBIT "A"' AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be authorized to execute an agree-
ment with Clower Interests, developers of La Joya Subdivision, providing for
payment to the City of $30,000 for the privilege of utilizing a City-constr cted
off-site storm sewer and providing for the dedication of right-of-way of
Martin Street, all as more fully set forth in the agreement, a substantial
copy of which is attached hereto and made a part hereof, marked Exhibit "A".
SECTION 2. The necessity to authorize execution of the aforesaid
agreement at the earliest practicable date creates a public emergency and
an imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction and that such ordinance or resolution shall be read at three
several meetings of the City Council, and the Mayor, having 'declared that such
emergency and necessity exist, having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its introduction
and take effect and,be in full force and effect from and after its passage,
IT IS ACCORDINGLY SO ORDAINED, this the 22 -day of October 1980.

AGREEMENT
THE STATE OF TEXAS
COUNTY 0f NUECES I
THIS AGREEMENT is entered into between the City of Corpus Christi,
hereinafter called "City", and Clower Interests, hereafter called "Developer".
WHEREAS, the Developer in compliance with the City's Platting
Ordinance, is proposing todevelop a subdivision to be known as La Joya
Estates located in the City of Corpus Christi, and;
WHEREAS, the preliminary plat of La Joya Estates has been approved
by the Planning Commission of the City of Corpus Christi, and;
WHEREAS, Developer proposes to construct Unit 1 of La Joya Estates
Subdivision as shown on the attached EXHIBIT A, and;
WHEREAS, Developer proposes to utilitze a storm sewer outfall -to be
constructed by the City immediately south of La Joya Estates Subdivision.
NOW, THEREFORE, the City and the Developer agree as follows:
1. The Developer agrees to reimburse the City $30,000.00 (Thirty
Thousand and no/100 dollars) as the agreed Developer share for the privilege
of utilizing the described City Storm Sewer Outfall.
2. Developer agrees to pay 1/2 of the agreed share, or $15,000.00
(Fifteen Thousand and no/100 dollars) to the City at the time construction
plans for Unit 1 of La Joya Estates are approved. The remaining $15,000.00
(Fifteen Thousand and no/100 dollars) will be paid the City concurrently with
the platting of any portion of La Joya Estates after Unit 1 is platted, as
shown on attached EXHIBIT A.
3. In addition to the stated storm sewer participation herein
Developer also agrees to dedicate, concurrently with City plan approval for
La Joya Unit 1, all of the portions of Martin Street, as shown on EXHIBIT A.
4. The Agreement shall become effective and shall be binding upon
and shall inure to the benefit of the parties hereto and their respective heirs,
successors and assigns from and after the date of execution.
EXECUTED IN DUPLICATE, each of which shall be considered an original,

TO THE MEMBERS OF THE CITY COUNCIL

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
