TEXAS:
AN ORDINANCE
ACCEPTING GIFT OF REMAINDER INTEREST IN .29 ACRES OUT
OF ARROYO TRACT "C" IN THE CITY OF CORPUS CHRISTI,
NUECES COUNTY, TEXAS DEVISED TO THE CITY BY THE WILL
OF THE LATE PEARL MOORE WESTERVELT; RATIFYING REDEMPTION
TENDERS MADE BY THE CITY MANAGER; AUTHORIZING THE CITY
ATTORNEY TO FILE SUIT TO RECOVER SUCH PROPERTY FOR THE
CITY OF CORPUS CHRISTI, TEXAS; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City Council hereby accepts the devise of a
remainder interest in .29 acres out of Arroyo Tract "C" in the City of
Corpus Christi, Nueces County, Texas, for park purposes, as more particularly
described in a map or plat thereof in the Map Records of Nueces County,
Texas, and said property being at the intersection of Carrizo and B'lucher-
Streets, also known as 210-212 Carrizo Street, in the City of Corpus Christi,
Nueces County, Texas, and confirms the acceptance by implication when the
City Manager was notified of such gift by Thelma S. Hatchitt,-Independent
Executrix of the Estate of Pearl Moore Westervelt on January 7, 1974,
SECTION 2. That the redemption tenders made to Harry Pinson,
the purchaser of said property at a tax sale, and to his attorney of record,
Charles Cartwright, by the City Attorney on instruction from the City Manager
on November 27, 1979 in the sum of $1,638.72 and repeated on December 11,
1979 in the sum of $2,084.08, are hereby ratified and confirmed.
SECTION 3. The sum of $2,084.08 is hereby reappropriated out
of the reserve appropriation in the General Fund in payment of said tender
when directed by a court of appropriate jurisdiction or if accepted volun-
tarily by the said Harry Pinson.
SECTION 4. The City Attorney is authorized to institute legal
proceedings to recover the property above described for the City in view of
Harry Pinson's refusal to accept redemption offer made by the City in
accordance with the tax deed and Article 7345b of the Revised Civil Statutes
of the State of Texas. .
SECTION 5. The necessity to accept the gift of remainder interest
in .29 acres out of Arroyo Tract "C" in the City of Corpus Christi, Nueces

County, Texas at the earliest possible date creates a public emergency and
an imperative public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the date of its
introduction but that such ordinance'or resolution shall be read at three
several meetings of the City Council, and the Mayor having declared that such
. emergency and necessity exist, having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its introduction
and take effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED,
this the 029 day of October, 1980.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council;. I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
