Home My WebLink About15859 ORD - 11/05/1980' 10-10-80 AN ORDINANCE AMENDING SECTION 49-5 OF THE CORPUS CHRISTI CITY CODE TO ADD AN EXCEPTION FOR NEWSPAPER VENDING MACHINES, UPON CERTAIN CONDITIONS AS SET OUT IN THE BODY OF THE ORDINANCE; PROVIDING FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS ,•, if CHRISTI, TEXAS: • SECTION 1. That Section 49-5 of the Corpus Christi City Code be and the same is hereby amended to add a new paragraph to read as follows; "Nothing herein contained shall apply to the placing or displaying of daily newspapers in vending machines upon any sidewalk or sidewalk area along any arterial or collector street so long as each such vending machine is located in such a way that no safety hazard and no impediment to pedestrian or vehicular traffic will occur. No such vending machine shall be located within 20 feet of any intersection. Each such vending machine shall be con- fined to an area extending no more than three feet from the curb line or any area extending no more than three feet from the lot line. The vendor shall notify in advance the record owner of adjoining property of the placement of the vending machines. The vendor shall be required to submit information regarding the adequacy of wind design capacity of the anchoring system for each such vending machine which shall be consistent with the hurricane pre- cautions required by the Carpus Christi Building Code. Each vendor shall be solely responsible for prevention and removal of litter created in the opera- tion of any such vending machine he has placed. By placement of any such vending machine, the vendor agrees to hold harmless the City of Corpus Christi from any and all claims causes of action for damages whatsoever which might arise either solely or in part by placement of such vending machine, and an indemnity agreement shall be executed between the vendor as indemnitor and the d City as indemnitee to effectuate said agreement. Further to this end, the vendor shall maintain on file in the City Secretary's office a certificate of insurance evidencing public liability insurance in the amount of $1,000,000 naming the City of Corpus Christi as an additional insured. The vendor shall maintain each vending machine in first class working condition. Each vending machine shall be kept currently stocked with publications and shall be free from all advertising except that which identifies the publication. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. - 2 - That the foregoing ordinance was read for a ( time and passed to its - second reading on this the Z2- day of ____ ,cti, , 19 9O , by the following vote: Luther Jones Edward L.
