HomeMy WebLinkAbout15863 ORD - 11/05/1980irk ,- AN ORDINANCE CLOSING AND ABANDONING THE 10' WIDE UTILITY EASEMENT OUT OF LOT 32, BLOCK 2, GREENWAY GARDENS TOWNHOUSES, AS RECORDED IN VOLUME 46, PAGES 23 AND 24, MAP RECORDS OF NUECES COUNTY, TEXAS, AS MORE FULLY DESCRIBED HEREINAFTER; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10' wide utility easement in Lot 32, Block 2, Greenway Gardens Townhouses, as recorded in Volume 46, Pages 23 and 24, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter more fully described 10' wide utility easement in Lot 32, Block 2, Greenway Gardens Townhouses, as recorded in Volume 46, Pages 23 and 24, Map Records, Nueces County, Texas, be and the same in hereby closed for public use and every municipal purpose, said easement being described as follows: FIELDNOTES for the abandonment of a 10.00 foot wide utility easement out of Lot 32, Block 2, Greenway Gardens Townhouses, a map of which is recorded in Volume 46, Pages 23 and 24, Map Records of Nueces County, Texas: BEGINNING at a point on the Southeast right-of-way line of Rodd Field Road, from which point the most West corner of said Lot 32, Block 2, bears South 28°57'30" West, 129.01 feet; THENCE South 61°00'00" East 10.00 feet to the point of beginning; THENCE North 28°57'30" East, 10.00 feet to a point for the North corner of this easement; THENCE South 61°00'00" East 309.44 feet to a point for the East corner of this easement; THENCE South 29°00'00" West, with the Northwest boundary line of an existing 10.00 feet utility easement, 10.00 feet to a point for the South corner of this easement; TN ENCE North 61°00'00" West, 309.44 feet to the POINT OF BEGINNING. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, MICROFILMED SEP 271984 15863 word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of November, 1980. • ATTEST: Ci y Secretary' APPRQVED: 4- DAY OF NOVEMBER, 1980: J.
