V, PAGE 86, DEED RECORDS OF NUECES COUNTY, TEXAS; A RIGHT- OF-WAY AND EASEMENT FOR THE LAYING OF WATER PIPES FOR CONVEYANCE OF A WATER SUPPLY, AS FILED IN VOL. 27, PAGE 4Q4, DEED RECORDS, NUECES COUNTY, TEXAS; AND A 12 -FOOT RIGHT-OF-WAY TO THE CORPUS CHRISTI WATER COMPANY, AS FILED IN VOL. V, PAGE 94, DEED RECORDS, NUECES COUNTY, TEXAS, ALL INSTRUMENTS BEING CONVEYED TO THE CITY OF CORPUS CHRISTI, AND FILED FOR RECORD IN THE DEED RECORDS OF NUECES COUNTY, TEXAS, QUITCLAIMING ANY INTEREST IN ANY SUCH RIGHT-OF-WAY; AND DECLARING -AN -EMERGENCY. WHEREAS, there exist a 12 -foot right-of-way for construction of a water works system, as recorded in Vol. V, page 86, Deed Records of Nueces County, Texas; a right-of-way and easement for the laying of water pipes for conveyance of a water supply as recorded in Vol. 27, page 404, Deed Records, Nueces County, Texas; and a 12 -foot right-of-way and quitclaim to the Corpus Christi Water Company, as recorded in Vol. V, page 94, Deed Records of Nueces County, Texas, all instruments being conveyed to the City of Corpus Christi and filed for record in the Deed Records of Nueces County, Texas; and - WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon and quitclaim said easements and rights- pf-way: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the grant of a 12 -foot right-of-way for construction of a water works system, as recorded in Vol. V, page 86, Deed Records of Nueces County, Texas, and described therein, dated September 13, 1890, conveying such right-of-way from the Catholic Convent to Corpus Christi Water Company; that the right-of-way and easement for the laying of water pipes for conveyance of a water supply, as recorded in Vol. 27, page 404, Deed Records, Nueces County, Texas, and described therein, dated November 11, 1892, conveying such right-of-way and easement from Convent of the Incarnate Word to the City of Corpus ,Christi; MICROFILMED SEP 71984 15861 and the 12 -foot right-of-way and quitclaim granted to the Corpus Christi Water Company, by John Dunn as recorded in Vol. V, page 94, Deed Records, Nueces County, Texas, and described therein, dated September 26, 1890, all easements and rights-of-way having been conveyed to the City of Corpus Christi and/or its pre- decessor in title to the Municipal Water Supply System, and filed for record in the Deed Records of Nueces County, Texas, be and the same are hereby closed for public use and every municipal purpose and abandoned and quitclaimed to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants of the City of Corpus Christi, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any othersection, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easements and rights-of-way creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 5th day of November , 1980.
