HomeMy WebLinkAbout15869 ORD - 11/05/1980j kh:11-5-80;1 st ' AN ORDINANCE • AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND' RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF SITTERLE & COMPANIES BY CHANGING THE ZONING OF TRACT 1, MORE FULLY DESCRIBED HEREINAFTER, BEING, A; PORTION OF LOTS 1'AND 2, SECTION 5, RANGE VIII, off, GUGENHEIM AND'COHN'S FARM LOTS,•FROM "A-2" APARTMENT= HOUSE DISTRICT AND "R -1B" ONE FAMILY DWELLING DISTRICT TO "I-2" LIGHT INDUSTRIAL DISTRICT, AND CHANGING THE - ZONING OF TRACT 2, MORE FULLY DESCRIBED HEREINAFTER, • BEING A PORTION OF LOTS 1 AND 2, SECTION 5, RANGE VIII, GUGENHEIM AND COHN'S FARM LOTS, FROM "A-2" APARTMENT ' HOUSE DISTRICT AND "R-18" ONE FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Sitterle & Companies for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday October 29, 1980 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. . 15869 MICROFILMED SEP 2 719RA SECTION 2. That the zoning of the following described Tracts 1 and 2, being out of Lots 1 and 2, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots, situated in the City of Corpus Christi, Nueces County, Texas, be changed from "A-2" and "R -1B" zoning districts to "I-2" Light Industrial District as to Tract 1 and to "AB" Professional Office District as to Tract 2, said property being more particularly described as follows: TRACT 1 All of that certain tract of land containing 15 .36 acres, more or less, out of Lots 1 and 2, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots, as recorded in Volume A, pgae 53, Map Records, Nueces County, Texas; Beginning at a point 200.0 feet southerly from the centerline of the Bear Lane, and S 0° 01' 52" East, 170.0 feet from a 3/4" iron pipe, from whence the intersection of the northeast right-of-way line of South Padre Island Drive with the southerly right-of-way line of Bear Lane, a 60' road, bears S 89° 39' 43" East, a distance of 3481 .17 feet; Thence: S 0° 01' 52" East, a distance of 460.51' to a 1" iron pipe and the southeast corner of this tract; Thence: S 89° 40' 00" West, at 691 .35' a 5/8" iron rod, in all a distance of 1310.70' to a point for the southwesterly corner of this tract;— Thence: N 19° 17' 54" West, 698.39' to a point in the centerline of Bear Lane, the northwesterly corner of this tract; Thence: N 890 39' 43" East, a distance of 178.16' to a point being the intersection of the centerline of Bear Lane with the northerly extension of the proposed easterly line of Flato Road, a proposed 60' road, for corner; Thence: S 0° 16' 17" East, 200 .0 feet to a point for inside corner of this tract; Thence: N 89° 39' 43" East, parallel to and 200.0 feet southerly to the centerline of Bear Lane, a distance of 1362.16 feet to the point of beginning, said tract containing 15 .36 acres, more or less. TRACT 2 All of that certain tract of land containing 6.25 acres, more or Tess, out of Lots 1 and 2, Section 5, Range VIII, Gugenheim and Cohn's Farm Lots, as recorded in Volume A, pgae 53, Map Records, Nueces County, Texas; Beginning at a 3/4" iron pipe on the south right-of-way line of Bear Lane, said point being 3481 .17' N 89 ° 39' 43" East,from.a 1" iron pipe at the intersection of the northeast right-of-way of South Padre Island Drive (Texas Highway 358) with the south right-of-way of Bear Lane, a 60' wide road; Thence: N 0° 01' 52" West, 30.0 feet- to the centerline of Bear Lane and the north line of the Gugenheim and Cohn's Farm Lot 1 for the northeast corner of this tract; -2- .r • Thence: With the centerline of Bear Lane 5 89° 39' 43" West, 1363.00 feet to the intersection of the centerline of Bear Lane with the northerly extension of the proposed east right-of-way line of Flato Road, a proposed 60' foad for the northwest corner of this tract; Thence: S 0° 16' 17" E, with the proposed easterly line of Flato Road, 200.0 feet to a point for the southwest corner of this tract; Thence: N 89° 39' 43" E, parallel to and 200.0 feet southerly from the centerline of Bear Lane, a distance of 1362.16 feet to a point for the southeast corner of this tract; Thence: N 0° 01' 52" West, 170.0 feet to the place of beginning, said tract containing 6.25 acres of land, more or less. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force'and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from an ter its passage, IT IS ACCORDINGLY SO ORDAINED, this the s day of ATTEST: City Secretary 1. BRUCE AYCOCK, CITY ATTORNEY Corpus Christi, Texas day of TO THE MEMBERS OF THE CITY COUNCIL Corpus Christi, Texas For the reasons set forth in the emergency clause of the foregoing ordinance, a public emergency and imperative necessity exist for the suspension of the Charter rule or requirement that no ordinance or resolution shall be passed finally on the date it is introduced, and that such ordinance or resolution shall be read at three meetings of the City Council; I, therefore, request that you suspend said Charter rule or requirement and pass this ordinance finally on the date it is introduced, or at the present meeting of the City Council.
