HomeMy WebLinkAbout15870 ORD - 11/05/1980jkh:11-5-80;1st AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF •INTERNATIONAL BANK OF CORPUS CHRISTI BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT 1, MORE FULLY DESCRIBED HEREINAFTER, FROM "A-1" APART- MENT HOUSE DISTRICT TO "B-4" GENERAL BUSINESS DISTRICT AND BY CHANGING THE ZONING ON TRACT 2, MORE FULLY DESCRIBED HEREINAFTER, FROM "A-1" APARTMENT HOUSE DISTRICT TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXIST- ING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of International Bank of Corpus Christi for amendment to the zoning map of the City of Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday November 5, 1980, at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the zoning of Tract 1, hereinafter more fully described, be and the same is hereby changed from "A-1" Apartment House District to "B-4" General Business District, and that the zoning on Tract 2, more fully described hereinafter, be changed from "A-1" Apartment House District to "B-1" Neighborhood Business District, the said tracts being more fully described as follows: Tract 1 FIELDNOTE DESCRIPTION of a 0.178 acre, more or less, tract of land being a portion of Lot 12, Forest Park Addition Unit 2, as shown by plat recorded in Volume 21, Page 80, Map Records, Nueces County, Texas, and a portion of Lot 1, Block 2, Barthlome Addition, as shown by plat recorded in Volume 4, Page 55, Map Records, Nueces County, Texas, and a portion of vacated Rose Street adjacent thereto, said road having been vacated in part by City of Corpus Christi Ordinance No. 7332 and in part by City of Corpus Christi Ordinance No. 12078, said 0.178 acre tract being more particularly described as follows: BEGINNING at thenorthwestcorner of said Lot 12, said point being on the southeasterly right-of-way line of Nueces Bay Boulevard for the northwest corner and POINT OF BEGINNING of this tract; THENCE,' N 89° 37' 45" E, along the north boundary line of said Lot 12, a distance of 72.72 feet to a point for the northeast corner of this tract; THENCE, S 34° 02'4)0" W, 188.06 feet to a point on the centerline of said vacated Rose Street for the south corner of this tract; THENCE; N 3° 47' 00" W, along said centerline 97.86 feet to a point on the southeasterly right-of-way line of Nueces Bay Boulevard for the west corner of this tract; THENCE, N 34° 02' 00" E, along said right-of-way line 69.66 feet to the POINT OF BEGINNING. Tract 2 FIELDNOTE DESCRIPTION of a 2.460 acre, more or less, tract of land being a portion of Lot 12, Forest Park Addition Unit 2, as shown by plat recorded in Volume 21, Page 80, Map Records, Nueces County, Texas and a portion of Lot 1 and all of Lot 2, Block 2, Barthlome Addition, as shown by plat recorded in Volume 4, Page 55, Map Records, Nueces County, Texas, and a portion of vacated Rose Street adjacent thereto, said road having been vacated in part by City of Corpus Christi Ordinance No. 7332 and in part by City of Corpus Christi Ordinance No. 12078, said 2.460 acre tract being more particularly described as follows: BEGINNING at the southeast corner of said Lot 12, Forest Park Addition, Unit 2, said point being on the north right-of-way line of Buffalo Street for the southeast corner and POINT OF BEGINNING of this tract; THENCE, S 89° 46' 10" W, at 204.86 feet pass the common southwest corner of said Lot 12 and the southeast corner of Lot 2, Block 2, said Barthlome Addition, at 254.97 feet pass the southwest corner of said Lot 2, Block 2.and the easterly right-of-way line of said vacated Rose Street, in all a distance of 285.04 feet to a point on the centerline of said Rose Street for the southwest corner of this tract; THENCE, N 3° 47' 00" W, along said centerline 207.68 feet to a point for an exterior corner of this tract; -2- ti THENCE, N 34° 02' 00" E, 188.06 feet to a point on the north boundary line of said Lot 12 for the northwest corner of this tract; THENCE, N 89° 37' 45" E, along said north boundary line of Lot 12, a distance of 328.14 feet to the northeast corner of said Lot 12 for the northeast corner of this tract; THENCE, S 0° 12' 50" E, 63.50 feet to the northeast corner of Lot 13, said Forest Park Addition Unit 2, and an exterior corner of :.aid Lot 12 for an exterior corner of this tract; THENCE, S 89° 46'10" W, 136.00 feet to the northwest corner of said Lot 13, and an interior corner of said Lot 12 for an interior corner of this tract; THENCE, S 0° 12' 50" E, 300.00 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of 19 Si, .
