HomeMy WebLinkAbout15878 ORD - 11/12/1980AN ORDINANCE CLOSING AND ABANDONING A PORTION OF A 10 -FOOT UTILITY EASEMENT IN LOT 15, BLOCK 1, ARLINGTON HEIGHTS UNIT 3, AS FILED IN VOL. 42, PAGE 63, MAP RECORDS, NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot wide utility easement in Lot 15, Block 1, Arlington Heights Unit 3, filed for record in Volume 42, Page 63, Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon a portion of said easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the hereinafter described portion of a 10 -foot utility easement in Lot 15, Block 1, Arlington Heights Unit 3, filed for re- cord in Volume 42, Page 63, Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose and abandoned to the owners of the abutting property in accordance with the laws of the State of Texas, and for the service and interest of the inhabitants_of the City of Corpus Christi, Texas, said portion being more particularly described as follows: FIELDNOTES for the abandonment of a portion of an existing 10_00 foot wide utility easement adjacent to the North line of Lot 15, Block 1, Arlington Heights, Unit 3, Corpus Christi, Nueces County, Texas, a map of which is re- corded in Volume 42, Page 63, Map Records of Nueces County, Texas: BEGINNING at the point of intersection of the Southeast right-of-way line of Buckingham Street and the Northeast right-of-way line of Leopard Street for -the common front corner of said Lot 15 and Block A, Church Site, Arlington Heights, a map of which is recorded in Volume 21, Page 68 of said Map Records and the North- west corner of this casement; THENCE North 89°54'10" East, with the common boundary line of said Lot 15 and Block -A, 343.10 feet for the Northeast corner of this easement; THENCE South 00°05'50" East, 10.00 feet to a point on the existing South line of a 10.00 foot wide utility easement for the Southeast corner of this easement; THENCE South 89°54'10" West, along the South line of said utility easement, 321.55 feet to a point on said Northeast right-of-way line of Leopard Street for the Southwest corner of this easement; THENCE North 65°11'50" West, with said Northeast right-of-way, 23.75 feet to the PLACE OF BEGINNING. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the described portion of utility easement creates a public emergency and an imperative public necessity re- quiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the /2— day of November, 1980.
