AN ORDINANCE
AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS
CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937,
APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ,
OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED
FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY
ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF
CANDY STICK CORPORATION BY
AMENDING THE ZONING MAP BY CHANGING THE ZONING ON
9.92± ACRES OUT OF GREGORIO FARIAS GRANT STATE
ABSTRACT NO. 592
SITUATED IN THE,CITY OF CORPUS CHRISTI, NUECES COUNTY,
TEXAS, FROM "F -R" FARM RURAL DISTRICT
TO "R -1B" ONE FAMILY UWELLING UISTRILI
; KEEPING IN EFFECT ALL OTHER PROVISIONS
OF, THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL
ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN
EMERGENCY.
WHEREAS, the Planning Commission has forwarded to the City Council
its reports and recommendations concerning the application of
Candy Stick Corporation for amendment to the zoning map of
the City. of Corpus Christi;
WHEREAS, public hearing was held at which hearing all persons
wishing to appear and be heard were heard, to consider the same before the
City Council of the City of Corpus Christi, in accordance with proper notice
to the public, said public hearing having been held on Wednesday
November 19, 1980 , at Special .Council Meeting of the
City Council in the Council Chamber at City Hall in the City of Corpus Christi;
and
• WHEREAS, by motion duly made, seconded and carried, it was decided
by the City Council that to approve the hereinafter set forth amendment would
best serve public health, necessity and convenience and the general welfare
of the City of Corpus Christi and its citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the Zoning Ordinance of the City of Corpus
Christi, Texas, passed on the 27th day of August, 1937, appearing of record
in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as
amended from time to time, and in .particular as amended by Ordinance No. 6106,
as amended, be and the same is hereby amended by making the change hereinafter
set out.

SECTION 2. That the hereinafter more fully described 9.92+
acre tract of land out of Gregorio Farias Grant State Abstract No. 592,
be and the same is hereby changed from "F -R" Farm Rural District to "R -1B"
One Family Dwelling District:
Being a 9.92 acre tract, more or less, out of that certain
39.93 acre tract out of the Gregorio Farias Grant, Abstract
4592; said 39.93 acre tract conveyed to Oliver Marion Hearn
by Nannie F. Hearn and recorded in Volume 1017, page 528 of
the Deed Records of Nueces County, Texas, and a 1.07 acre tract
known as Share 2 of the Partition of the Hearn Tract:
BEGINNING at a 1#" iron pipe, the East corner of said 39.93 acre tract,
the North corner of Share 4 of the John Harney Partition, a map of which is
recorded in Volume 6, Page 29 of the Map Records.of said County, for the East
corner acid Point of Beginning of this tract;
THENCE South 37°30'10" West along the common boundary line of said 39.93
acre tract and Share 4 a distance of 280' to the South corner of this tract;
THENCE North 53°18'55" West 1,018.93' to a corner;
THENCE North 70°49'50" West 398.75' to a point in the Easterly right-of-
way line of F.M. 1694 (Callicoatte Road) for the West corner of this tract;
THENCE North 36°41'05" East along said right-of-way line 81.50'
point of curve of a circular curve to the right;
THENCE with said curve whose central angle equals 6°25', radius equals
2,825', -tangent equals 158.34' for an arc distance of 316.36' to the point
of tangency;
THENCE North 43°06'05". East 45.22' to the North corner of said Share
2 and the North corner of this tract;
THENCE South 49°59'10" East at 185.52' pass the East corner of said
Share 2, the North corner of said 39.93 acre tract, and continuing with the
Northeast line of said 39.93 acre tract 332.86' for a distance of 518.38'
to a corner;
to the
THENCE South 52°27'50" East continuing with the Northeast boundary line
of said 39.93 acre tract 658.09' to a corner;
THENCE South 52°40'25" East 204.92' to the POINT OF BEGINNING.
SECTION 3. That the official zoning map of the City of Corpus
Christi, Texas, be, and the same is hereby, amended as herein ordained.
SECTION 4. That the Zoning Ordinance and Map of the City of
Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended
from time to time, except as herein changed, shall remain in full force"and
effect.
SECTION 5. That all ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
SECTION 6. That the necessity of immediately making aforesaid
change for the purpose of maintaining at all times a comprehensive zoning
ordinance for the City of Corpus Christi creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule'that
no ordinance or resolution shall be passed finally on the date of its introduc-
tion and that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared that such emergency
and necessity exist, having requested the suspension of the Charter rule
and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from an

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally on the date it
is introduced, or at the present meeting of the City Council.
