HomeMy WebLinkAbout15894 ORD - 11/19/1980jkh:11-19-80;lst -•moo so*" • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CLIFF ZARSKY-TEXAN HOMES BY 'AMENDING THE ZONING MAP BY CHANGING THE ZONING ON PORTION OF SECTION 50, FLOUR BLUFF & ENCINAL FARM & GARDEN IRACIS SITUATED IN THE CITY OF CORPUS CHRISTI NUECES COUNTY, TEXAS, FROM "R -1B" ONE FAMILY DWELLING DISTRICT TO"R-2"MULTIPLE DWELLING DISTRICT ; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Cliff Zarskv-Texan Homes for amendment to the zoning map of the City oi-Corpus Christi; WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on Wednesday November 19, 1980 , at Special Council Meeting of the City Council in the Council Chamber at City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565, et seq, of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, as amended, be and the same is hereby amended by making the change hereinafter set out. That the zoning of the hereinafter more particularly described portion of Section 50, Flour Bluff & Encinal Farm & Garden Tracts, be and the same is hereby changed from "R -1B" One Family Dwelling District to "R-2" Multiple Dwelling District: FIELDNOTES for 24.10 acres of land proposed for re -zoning out of Lots 5, 6, Section 50, Flour Bluff and Encinal Farm and Garden Tracts, a map of which is recorded in Volume A, Pages 41, 42, 43, Map Records of Nueces County, Texas: BEGINNING at a point on the South right-of-way line (40.00 feet wide) of Gienoak Drive for the Northwest corner of a 90.00 foot wide drainage ease- ment conveyed to the City of Corpus Christi by Jon Held, Dr. John Hogan and wife, Beverly Hogan, dated August 5, 1980, File No. 190917 and recorded in Volume 1750, Pages 281-284, Deed Records of Nueces County, Texas, and the Northeast corner of this tract; THENCE South 29°00'00" West, leaving said right-of-way, and traveling along the West boundary line of said 90.00 foot wide drainage easement, 40.00 feet for the point of curvature of a circular curve to the left which has a central angle of 72°26'12", a radius of 298.34 feet, a tangent distance of 218.50 feet and an arc length of 377.18; THENCE with said curve to the left, along said West drainage right-of- way, 377.28 feet for the point of tangency and the point of reverse curve to the right which has a central angle of 72°26'12", a radius of 208.34 feet, a tangent distance of 152.58 feet•and an arc length of 263.40 feet; THENCE with said curve to the right, along the West boundary line -of said drainage easement, 263.40 feet for the Southwest corner of said 90.00 foot wide drainage easement and an inside corner of this tract; THENCE South 61°00'00" East, along the South boundary line of said 90.00 foot wide drainage easement, 10.00 feet to a point on the West boundary line of an existing 80.00 foot wide drainage easement and a corner of this tract; THENCE South 29°00'00" West, along the West boundary line of said 80.00 foot wide drainage easement, parallel to the East boundary line of said Lot 6, Section 50 thereof and 91.19 feet distant therefrom, measured at right angles thereto, 776.96 feet to a point on the South boundary line of said Lot 6 for the Southeast corner of this tract; THENCE North 61°00'00" West, along the South boundary line of said Lot 6, 568.81 feet for the common corner of Lots 5, 6, 11, 12, Section -52 and the Southwest corner of this tract; THENCE North 29°00'00" East, with the common boundary line of Lots 5, 6, 660.00 feet for an inside corner of this tract; THENCE North 61°00'00" West 660.00 feet to a point on the common boundary line of Lots 4, 5 and a corner of this tract; THENCE North 29°00'00" East, with the common lot line of Lots 4, 5, 640.00 feet to a point on said South right-of-way line of Gienoak Drive for the Northwest corner of this tract; THENCE South 61°00'00" East, along the South right-of-way line of Gienoak Drive, parallel to the original centerline thereof and 20.00 feet distant there- from, measured at right angles thereto, 865.04 feet to the POINT OF BEGINNING. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be, and the same is hereby, amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1937, as amended from time to time, except as herein changed, shall remain in full force'and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 6. That the necessity of immediately making aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from an/ IT IS ACCORDINGLY SO ORDAINED, this the 19 day of 19 30 .
