HomeMy WebLinkAbout15901 ORD - 11/26/1980r AN ORDINANCE CLOSING AND ABANDONING A 2.5 FOOT WIDE UTILITY EASEMENT OUT OF A 10 FOOT WIDE UTILITY EASEMENT BEING IN LOT 4A, BLOCK 3, WAVERLY ESTATES UNIT 2 AS RECORDED IN VOLUME 44, PAGE 174, MAP RECORDS OF NUECES COUNTY, TEXAS, AS MORE FULLY DESCRIBED HEREINAFTER; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 2.5 foot wide utility easement out of a 10 foot wide utility easement in Lot 4A, Block 3, Waverly Estates Unit 2 as recorded in Volume 44, page 174, Map Records, Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: J SECTION 1. That the hereinafter more fully described 2.5 foot wide utility easement out of a 10 foot wide utility easement in Lot 4A, Block 3, Waverly Estates Unit 2, as recorded in Volume 44, page 174, Map Records, Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, said easement being described as follows: BEGINNING at the west corner of said Lot 4A: THENCE S61°15'20" East, 7.5 feet to the point of beginning; THENCE N29° East, 120.0 feet to a point; THENCE S61°15'20" East, 2.5 feet to a point; THENCE S29° West, 120.0 feet along a line 10 feet east of and parallel to the northwest lot line at said Lot 4A to a point; THENCE N61°15'20" West, 2.5 feet to the POINT OF BEGINNING. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid utility easement creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on kiLWEILMED 15901 SEP 471981 the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .24 day of Novem- ber, 1980.
