HomeMy WebLinkAbout15916 ORD - 11/26/1980vp:11/25/80:1st t AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH NUECES DEVELOPMENT COMPANY, DEVELOPER OF THE WOODLAND CREEK SUBDIVISION, UNIT 5, PROVIDING FOR CITY PARTICIPATION IN THE OVERSIZE/OVERDEPTH OF A SANITARY SEWER EXTENSION TO SERVE ADJACENT PROPERTY, A SUBSTAN- TIAL COPY OF WHICH IS ATTACHED HERETO AND MADE A PART HEREOF, MARKED EXHIBIT "A"; APPROPRIATING $22,139.09 OUT OF THE NO. 250 SANITARY SEWER BOND FUND, APPLIC- ABLE TO PROJECT NO. 250-77-34, WOODLAND CREEK SUBDI- VISION UNIT 5, OVERSIZE/OVERDEPTH OF SANITARY SEWER LINE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be authorized to execute an agreement with Nueces Development Company, developer of the Woodland Creek Subdivision, Unit 5, providing for City participation in the oversize/overdepth of a sanitary sewer extension to serve adjacent property, a substantial copy of which is attached hereto and made a part hereof, marked Exhibit "A". SECTION 2. That there is hereby appropriated the sum of $22,139.09 out of the No. 250 Sanitary Sewer Bond Fund, applicable to Project No. 250-77- 34, Woodland Creek Subdivision Unit 5, Oversize/Overdepth of Sanitary Sewer Line. SECTION 3. The necessity to authorize execution of the aforesaid agreement and appropriation of the sums set forth in order that the oversize/ overdepth of a sanitary sewer extension to serve adjacent property may be completed at the earliest possible date, creates a public emergency, requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the day of November, 1980. BRUE AYCOCK, CITY ATTORNEY By 49 Assistant C 'ttorney THE CITY OF CORPUS CHRISTI, TEXAS IIICROEILM 5916 ($UP271.9Cry re AGREEMENT THE STATE OF TEXAS COUNTY OF NUECES This agreement is entered into by and between the City of Corpus Christi, Texas, a municipal corporation, hereinafter called "City", and Nueces Development Company, hereinafter referred to as "Developer", and pertains to the City's share of the cost for improvements when City participation is set forth in the Platting Ordinance and for improvements required by the City over and above those set forth in the Platting Ordinance• in the development of Woodland Creek Subdivision Unit V. NOW, THEREFORE, for and in consideration of the mutual covenants and conditions herein exchanged and agreed to be kept and performed the City and Developer agree as follows: 1. The Developer will construct a 15" vitrified clay sewer line from the easterly boundary of subdivision and Pernitas Creek Drive westerly through Lots 11, 12, and 32, Block 11 and across Woodland Creek Drive to Station 4+45.00. This construction will be contracted for and financed by the Developer. 2. The City agrees to reimburse the Developer its share of the above described construction cost plus engineering as is shown on the attached Construction Cost Estimate, marked "Exhibit B", and Map, marked "Exhibit A", attached hereto and made a part hereof for purposes of this agreement, the amount of City reimbursement to the Developer shall not exceed Twenty—two Thousand One Hundred Thirty—nine and 09/100 Dollars ($22,139.09). Such reimbursement will be made by the City to Developer upon completion and acceptance of the improvements by City. 3. The Developer agrees to indemnify the City against any claims arising as a result of the project. EXECUTED IN DUPLICATE ORIGINALS this the day of , 1980.
