HomeMy WebLinkAbout15920 RES - 11/26/1980A RESOLUTION AUTHORIZING AND DIRECTING THE CITY MANAGER TO REQUEST A PUBLIC HEARING OF THE PUBLIC UTILITIES COMMISSION OF TEXAS ON A PROPOSED RULE DIRECTING ELECTRIC UTILITY TO PASS THROUGH THE COST OF CITY FRANCHISE FEES TO CON- SUMERS LIVING WITHIN THE CITY; AND DECLARING AN EMERGENCY. WHEREAS, the Public Utilities Commission of Texas proposes to adopt a rule December 18, 1980, directing electric utilities to pass through the cost of city .franchise fees to city consumers; and directly allocate such fees to consumers living within cities; and WHEREAS, such action would be detrimental to consumers of electricity in this city; and would result in higher electric utility bills; and WHEREAS, the Public Utilities Commission is required to hold a public hearing on proposed rule changes upon request of a proper party: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager is hereby authorized and directed to request a public hearing on the aforesaid proposed rule change in behalf of the City of Corpus Christi. SECTION 2. The necessity to authorize the City Manager to request a public hearing at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or/resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this resolu- tion be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this the 26th day of November, 1980.
