HomeMy WebLinkAbout15928 ORD - 12/10/1980,AN ORDINANCE CLOSING AND ABANDONING THE FOLLOWING RIGHTS-OF-WAY OUT OF JACKSON WOODS, UNIT 1, AS DEDICATED IN PLAT OF JACKSON WOODS, UNIT 1, RECORDED IN VOL. 26, PAGES 15 AND 16, MAP RECORDS OF.NUECES COUNTY, TEXAS, AND ONLY AS TO THAT AREA SO DEDICATED: 1. 50 -FOOT RIGHT OF WAY KNOWN AS CLARKSBURG STREET, BETWEEN STONEWALL BOULEVARD AND GETTYSBURG STREET; 2. AN IRREGULAR SHAPED PORTION OF RIGHT-OF-WAY .. OUT OF GETTYSBURG STREET; 3. 10 -FOOT WIDE UTILITY EASEMENT BETWEEN LOTS 35 AND 36, BLOCK F, JACKSON WOODS, UNIT 1, SAID PORTIONS BEING MORE FULLY DESCRIBED HEREINAFTER; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of a portion of the hereinafter more fully described "" rights-of-way in Jackson Woods, Unit 1, situated in the City of Corpus Christi, Nueces County, Texas, was given by publication and mail to the last known address of the owners of property abutting the hereinafter more fully described rights-of-way and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Council Meeting of the City Council of the City of Corpus Christi on Wednesday, November 26, 1980, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close the hereinafter more fully described rights-of-way and that the same revert to the abutting property owners: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the following described rights-of-way in Jackson Woods, Unit 1, as dedicated in plat of said Jackson Woods, Unit 1, recorded in Vol. 26, pages 15 and 16, Map Records of Nueces County, Texas, and only as to that area so dedicated, be and the same are hereby closed for public use and abandoned to the abutting property owners: _ 5928 ylt LW ED g P2719g4 Parcel 1 Being a 50 -foot right-of-way known as Clarksburg Street between Stonewall Boulevard and Gettysburg Street, more fully described as follows: Being an irregularly shaped tract out of Clarksburg Street right-of-way, Jackson Woods Unit 1, as shown by map of record in Volume 26, Pages 15-16, Nueces County, Texas. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase; word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the -said rights-of-way as aforesaid creates a public emergency and an imperative public necessity requiring the sus- pension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect fr' . d after its p(a)ssage, IT IS ACCORDINGLY SO ORDAINED, this thJ0 9 day of , ,.`� , 19 .
