HomeMy WebLinkAbout15933 ORD - 12/17/1980,4 vr. 7 AN ORDINANCE AMENDING THE PLATTING ORDINANCE, SECTION IV, DESIGN STANDARDS, SUBSECTION F, PARKS AND PLAYGROUNDS, BY ADDING A NEW PARAGRAPH, TO BE NUMBERED 2, STATING THAT ANY FINAL PLAT APPROVED BY THE PLANNING COMMISSION WITHIN SIX MONTHS FROM MAY 7, 1980 THAT IS LOCATED IN THE AREA NORTH OF HIGHWAY #37 AND WEST OF THE PRESENT CITY LIMITS OF THE CITY OF CORPUS CHRISTI IS DEVELOPED FOR INDUS- TRIAL PURPOSES IS EXEMPT FROM ANY PARK AND RECREATION REQUIREMENTS; AMENDING SUBPARAGRAPH (d) OF SUBSECTION F, PARKS AND PLAYGROUNDS, BY ADDING TO THE AREAS EXCEPTED FROM PARK DEDICATION ANY PROPERTY WHICH WAS IMPROVED FOR PURPOSES OTHER THAN AGRICULTURE USES PRIOR TO MARCH 15, 1963 AND NOT BEING SUBDIVIDED; AND PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Platting Ordinance, Section IV, Design Standards, Subsection F, Parks and Playgrounds, as amended, be amended by adding a new para- graph, to be numbered 2, to hereafter read as follows: "2. Any final plat approved by the Commission within six months from May 7, 1980, located in the area north of Highway #37 and west of the present city limits of the City of Corpus Christi and developed for industrial purposes is exempt from any park and recreation requirements." - SECTION 2. That the Platting Ordinance, Section IV, Subsection F, be further amended by amending subparagraph (d) by adding to the areas excepted from park and playgrounds, by adding to the areas excepted from park dedication any property which was improved for purposes other than agriculture uses prior to March 15, 1963 and not being subdivided, said subparagraph (d) to hereafter read as follows: "(d) The above subsections a, b, and c shall not apply in the case of a replat of an existing plat, subdivision or addition that has previously set aside park requirements, or for any property which was improved for purposes other than agricultural uses prior to March 15, 1963 and not being subdivided, or for land utilized for uses allowed only within the "I-2" Light Industrial or "I-3" Heavy Industrial Zoning Districts and zoned "I-2" or "I-3" if inside the City of Corpus Christi. The owners of such "I-2" or "I-3" property shall execute a con- tract with the city which shall be a covenant running with the land and be filed .,' in the county deed records. Such contract shall stipulate the per acre value to be used to meet park dedication requirements if such land is every developed with a use not listed in the "I-2" or "1-3" Zoning District regulations; said owner of any lot so restricted shall be required to pay into the City's Park Development MICROFILMED SEP 2 71994 15933 a Fund monies equivalent to the raw land value of five percent (5%) of the area of the lot which is measured and calculated to the centerline of any street• bounding said lot plus 6% interest from the time of filing of the plat of the subdivision. Said deposit to be made at the time building and/or occupance permit fees are paid." SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, word, phrase, or provision hereof be given full force and effect for its purpose.
