AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE DOCUMENTS
NECESSARY FOR THE ACQUISITION OF TWO EASEMENTS IN
CONNECTION WITH THE OAKDALE DRIVE SANITARY SEWER
LATERALS PROJECT, NO. 250-77-31; APPROPRIATING OUT
OF THE NO. 250 SANITARY SEWER BOND FUND THE SUM OF
$1,015 FOR ACQUISITION; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
TEXAS:
SECTION 1. That the City Manager be, and he is hereby authorized
to execute documents necessary for the acquisition of two easements in connec-
tion with the Oakdale Drive Sanitary Sewer Laterals Project, No. 250-77-31.
The tract of land from Frame J. Bowers, Jr. and wife, Nancy R. Bowers, is
described as follows:
Being a tract of land out of Lot 2, Unit 1, Tropic Estates Sub-
division as shown by map of record in Volume 26, Page 12, Map
Records, Nueces County, Texas, and a portion of Lot 12,
Section 53, Flour Bluff and Encinal Farm and Carden
Tracts as -shown by map of record in Volume A, Pages 41, 42, 43,
Map Records, Nueces County, Texas and more particularly des-
cribed by metes and bounds as follows:
Beginning at a point being the most northerly corner of above-
mentioned Lot 2;
Thence N. 290 00' E., along a line, a distance of 100.0 feet
to a point said point being on the most westerly line of Lot 12;
Thence S. 61' 00' E., along a line that is 100.0 feet north-
east of and parallel to the northeast line of Lot 2, a dis-
dance of 12.5 feet to a point;
Thence S. 29° 00' W., along a line that is 30.0 feet south-
east of the northwest line of Lot 2, a distance of 370.0 feet
to a point on the southwest line of Lot 2;
Thence N. 61° 00' W., along the southwest line of Lot 2, a
distance of 7.5 feet to a point;
Thence N. 29° 00' E., along a line that is 5.0 feet south-
east of and parallel to the northwest line of Lot 2, a dis-
tance of 270.0 feet to a point;
Thence N. 61° 00' W., along the northeast line of Lot 2, a
distance of 5.0 feet to the point of beginning and contain-
ing 0.075 acres, more or less.
Together with a 22.5' wide temporary construction easement east
of and adjacent to'the above described utility easement_to_be
used for working room and storage of materials and equipment.
Said temporary construction easement to be abandoned upon com-
pletion of the project for which this easement is required.
The tract of land to be acquired from Jon B. Held is described as follows:
Being a tract of land out of Lot 12, Section 53, Flour Bluff
and Encinal Farm and Garden Tracts as shown by map of record
in Volume A, Pages 41, 42, 43, Map Records, Nueces County,
Texas and more particularly described by metes and bounds as
follows:
Beginning at point being the most easterly corner of Lot 17,
.Block 2, Waldron Oaks Subdivision as shown by map of record in
Volume 19, Page 95, Map Records, Nueces County, Texas;

Thence N. 290 00' E., along a line, a distance of 50.0 feet to
a point;
Thence S. 61° 00' E., along a line, a distance or 12.5 feet to
a point;'
Thence S. 29' 00' W., along a line that is 12.5 feet southeast
of and'parallel to the southeast line of Lot 17, a distance of
285.0 feet to a point;
Thence N. 61° 00' W., along aline, a distance of 12.5 feet to
a point, said point being on the southeasterly line of Lot 17;
Thence N. 29' 00' E., along the southeasterly line of Lot 17,
a distance of 235.0 feet to the point of•beginning and con-
taining 0.082 acres, more or less.
Together with a 22.5' wide temporary construction easement east
of and adjacent to the above described utility easement to be
used for working room and storage of materials and equipment.
Said temporary construction easement to be abandoned upon com-
pletion of the project for which this easement is required.
SECTION 2. There is hereby appropriated out of the No. 250 Sanitary
Sewer Bond Fund the sum of $1,015 for acquisition.
SECTION 3. The necessity to authorize acquisition of the aforesaid
tracts of land and to appropriate the necessary sums in order that the project
may continue without delay creates a public emergency and an imperative public
necessity requiring the suspension of the Charter rule that no ordinance or
resolution shall be passed finally on the date of its introduction and that
such ordinance or resolution shall be read at three several meetings of the
City Council, and the Mayor, having declared such emergency and necessity to
exist, having requested the suspension of said Charter rule and that this ordi-
nance be passed finally on the date of its introduction and take effect and
be in full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this the /7 day of December, 1980.

presents do grant and convey unto the City of Corpus Christi, Texas, a municipal
corporation duly incorporated under and by virtue of the laws of the State of
Texas, its successors and legal representatives the free and uninterrupted use,
liberty, privilege, and easement of going in, on, over, under and along a
certain tract of land situated in Nueces County, Texas and being described as
follows:

and keeping sanitary sewer lines, and for the purposes of maintaining, servic-
ing, repairing, and inspecting said lines under, on, and along said tract.
To have and to hold, all and singular, the rights and privileges aforesaid to
the City of Corpus Christi, Texas its successors and legal representatives,
for the proper use as a sanitary sewer easement and sanitary sewer right-
of-way, for so long as used for such purpose, and if the use for said ease-
ment and way of said uses be ever abandoned, then in that event, the aforesaid
rights and privileges shall cease.

For the reasons set forth in the emergency clause of the foregoing ordinance, a
public emergency and imperative necessity exist for the suspension of the Charter
rule or requirement that no ordinance or resolution shall be passed finally on
the date it is introduced, and that such ordinance or resolution shall be read
at three meetings of the City Council; I, therefore, request that you suspend
said Charter rule or requirement and pass this ordinance finally,on the date it
is introduced, or at the present meeting of the City Council.
